unstar this property answer text <p><del class="ministerial">All political parties since WW2 have</del> <ins class="ministerial">Successive post-war Governments have followed</ins> the same policy. Up-rating UK State Pensions for recipients who are overseas residents is longstanding; state Pensions are payable worldwide and are up-rated where there is a legal requirement to do so.</p><p> </p><p>The policy on the up-rating of UK State Pensions paid to recipients living outside the UK has been in place for over 70 years. The UK State Pension is payable worldwide without regard to nationality. Entitlement to the UK State Pension is based on the national insurance contributions on a person’s national insurance record. The annual index-linked increases to UK State Pensions are paid to recipients overseas only where there is a legal requirement to do so, for example in EEA countries or in countries where there is a reciprocal agreement in place that provides for the up-rating of the UK State Pension. Under the terms of the Withdrawal Agreement, we have the basis on which to maintain State Pension up-rating when the UK exits the EU for those who are already receiving their UK State Pension as well as future UK State Pension recipients. We will wish to discuss State Pension up-rating for individuals not covered by the Withdrawal Agreement in future talks.</p><p> </p><p>As the Government set out in its Policy Paper ‘Citizens’ Rights – EU citizens in the UK and UK nationals in the EU’ we wish to secure continued reciprocal arrangements covering the up-rating of State Pensions even in the event of a no deal exit. If we exit the EU in these circumstances, we will up-rate the UK State Pension for those living in the EU in 2019-20.</p><p /> more like this

unstar this property answer text <p>The UK has seventeen reciprocal social security agreements with EU Member States which are in use between some or all of the Crown Dependencies and the relevant EU country which provide for reciprocal uprating of state pension. The EU countries are: Austria, Belgium, Croatia, Cyprus, Denmark, Finland, France, Germany, Ireland, Italy, Luxembourg, Malta, Netherlands, Portugal, Slovenia, Spain and Sweden. In the event the UK leaves without a withdrawal agreement, the UK will keep the role of pre-existing Reciprocal Agreements with individual Member States under review. Whether these come back into force will be subject to discussion and agreement between the UK and the relevant EU Member State.</p><p> </p><p>There are ten EU countries where there is no reciprocal social security agreement in place. Those countries are: Bulgaria, Czechia, Estonia, Greece, Hungary, Latvia, Lithuania, Poland, Romania and Slovakia.</p><p> </p><p>The UK government has taken the necessary steps to protect the rights of citizens through legislation and set out the measures it will take in a no deal scenario. The measures are based on the terms of the Withdrawal Agreement in the policy paper: “Citizens’ Rights - EU citizens in the UK and UK nationals in the EU” dated 6 December 2018. For social security arrangements, the UK will have retained EU law allowing the UK to apply the current social security coordination rules to protect those in receipt or entitled to a UK State Pension or benefit, including where they live in the EU. This will apply equally to citizens from all EU Member States. In a no deal scenario, we will uprate the UK State Pension for those living in the EU in 2019-20, with a view to securing continued reciprocal social security arrangements in future.</p>

unstar this property answer text <p>The Department’s document ‘Estimated costs of uprating State Pension in frozen rate countries’ <a href="https://www.gov.uk/government/publications/estimated-costs-of-uprating-state-pension-in-frozen-rate-countries" target="_blank">https://www.gov.uk/government/publications/estimated-costs-of-uprating-state-pension-in-frozen-rate-countries</a> shows that the estimated extra cost of up-rating the UK State Pension in countries where State Pension increases are not paid would be around £3 billion extra over five years, if all State Pensions in payment were increased to the amount that would have been payable if the recipients had never left the UK.</p><p> </p><p>The policy on the up-rating of UK State Pensions paid to recipients living outside the UK is clear and is a long-standing one of successive Governments since WW2. The annual index-linked increases are paid to UK State Pension recipients where there is a legal requirement to do so. For example, where UK State Pension recipients are living within the European Economic Area, Switzerland and Gibraltar or in countries where there is a reciprocal agreement in place that provides for the uprating of the UK State Pension. The Government has no plans to change this policy.</p>

The policy on up-rating the UK State Pension abroad is long-standing and unchanged. UK State Pensions are payable worldwide and they are up-rated for overseas residents where there is a legal requirement to do so.</p><p> </p><p>The cost of up-rating State Pensions would increase by more than £3 billion over five years if payments to recipients in countries where they are not currently up-rated were increased to the rates payable had the recipients never left the UK. unstar this property answer text <p>The three year State Pension up-rating guarantee was part of the Government’s no deal preparations. The Withdrawal Agreement has now been ratified.</p><p> </p><p>Under the terms of the Withdrawal Agreement, UK state pensioners living in the EEA or Switzerland by 31 December 2020 will have their state pensions increased annually as long as they continue living there.</p><p> </p><p>Currently, the basic state pension and amounts of new state pension up to the full rate are increased in line with the “triple lock” mechanism, which ensures they will rise each year by the highest of either 2.5 per cent, the rate of price inflation or average earnings growth.</p><p> </p><p>People will get their state pensions up-rated in the EU even if they claim their pension on or after 1 January 2021, as long as they meet the UK state pension qualifying conditions and are covered by the Withdrawal Agreement.</p><p /><p>The position of those who do not fall within the scope of the Withdrawal Agreement will be covered by the future relationship with the EU, which is yet to be negotiated.</p><p><strong> </strong></p><p> </p>

The Government understands that people move abroad for many reasons and that this can have an impact on their finances. However, the decision to move abroad remains a personal choice.
