unstar this property answer text <p>The Department of Energy and Climate Change does not hold this information centrally and it can only be provided at a disproportionate cost. The Department’s standard terms and conditions include a cancellation clause which provides for termination upon giving the supplier 28 days’ notice. The Department endeavours to manage its relationship with suppliers fairly and complies with all contractual obligations applicable prior to any termination.</p> more like this

Changes of price often occur when there is need for additional services. This involves negotiation will the contractor and is documented as a contract variation. The price for consultancy services is usually based upon agreed rates following supplier selection via competitive tender of the Crown Commercial Services ConsultancyOne framework. The price may change according to many variables depending on the nature of the work and circumstances.</p> more like this

unstar this property answer text <p>My rt. hon. Friend the Secretary of State announced back in April that the department would pay all of its employees the Living Wage from 1 April 2014. Legal advice was sought during consideration and implementation of this policy. At the time no implications in respect of the EU public procurement regime were identified.</p><p>Payment of the Living Wage may fall foul of European Community law, in particular the Posted Workers Directive (PWD). This point rests on whether payment of the Living Wage is mandated, in which case there is a risk of being in breach of the PWD, or achieved through voluntary agreement. Since from a contractual perspective the changes needed mutual consent, there was no option for DECC other than to negotiate with suppliers to gain their agreement. We are satisfied therefore that this policy is compliant with EC law.</p> more like this

unstar this property answer text <p>The Department of Energy and Climate Change entered into a contract for the provision of transactional HR and finance services in November 2013 and incurred expenditure of £0.5m during 2013-14. This is equivalent to 0.01% of total departmental expenditure for the year. In previous years the equivalent services were provided to DECC by other government departments. Expenditure on these services in 2014-15 is forecast to be approximately £1.2m and to account for a similar proportion of total expenditure.</p> more like this
