star this property answer text <p>All children are entitled to an efficient full-time education which is suitable to their age, ability, aptitude and any special educational needs they may have.</p><p>Local authorities have a duty to make arrangements to establish the identities of children in their area who are of compulsory school age but are not registered pupils at a school and are not receiving suitable education otherwise than at a school.</p><p>If it appears to the local authority that a child of compulsory school age is not receiving suitable education, either by regular attendance at school or otherwise, then they have the power to begin procedures for issuing a school attendance order. The order will name a school at which the parent is required to register their child.</p><p>Where a pupil is not regularly attending school, local authorities and schools have a range of measures they can put in place to support school attendance.</p><p>In the 2020/21 academic year, local authorities made three requests for my right hon. Friend, the Secretary of State for Education, to issue a direction to comply with a school attendance order for academy schools. None of these requests resulted in a direction to admit. The time taken to issue a decision on these cases ranged from 4 days to 63 days, owing to the complexity of the individual cases.</p>

star this property answer text <p>A school’s admission authority is responsible for setting the published admission number (PAN) for each year in which children normally enter the school. This is usually the reception year in primary school and year 7 in secondary school. They must do so in line with the requirements of the school admissions code.</p><p>The local authority is the admission authority for community and voluntary controlled schools. For voluntary aided and foundation schools, the school’s governing body is the admission authority and is therefore responsible for setting the PAN.</p><p>Once they have determined their PAN, an admission authority may admit above that number but must notify the local authority of this in time to allow it to deliver its co-ordination responsibilities effectively. They may also admit above their PAN at any time through in-year admissions.</p><p>Where an admission authority proposes to decrease their PAN, they must first consult locally in accordance with the requirements set out in the school admissions code. This includes consulting with parents and all other admission authorities within the relevant area.</p><p>Community and voluntary controlled schools have the right to object to the Office of the Schools Adjudicator if the PAN set for them by the local authority is lower than they would wish. The decision of the Adjudicator is binding and enforceable.</p>

Friend, the Secretary of State for Education wrote to all directors of children’s services on 1 April 2022 asking them to assist refugees from Ukraine in finding school places as quickly as possible. The department followed this up with a similar message to every local authority admission officer on 4 April 2022.</p><p> </p><p>Admission authorities in England must always apply their published admission arrangements. There are no exceptions for Ukrainians or children of any other nationality.</p><p> </p><p>Local authorities in England do not have additional school admission obligations in relation to refugees from Ukraine, they have the same right to a school place as any other child resident in the UK. Local authorities in England have a duty to provide sufficient school places for children living in their area. Parents have a duty to ensure any of their children who are of compulsory school age receive a suitable education.</p><p> </p><p>It is not necessary to have a fixed home address in order to be allocated a school and admission authorities would be in breach of their legal obligations if they refused admission on this basis. The school admissions code states that admission arrangements must be clear about how a child’s home address will be determined.</p><p> </p><p>The department provides advice, in Ukrainian and Russian, to parents on finding a school place in the Ukraine welcome pack, similar to the advice we provide Hong Kong British National (Overseas) and Afghan migrants. The department have also recently updated our website giving advice to local authorities and schools on the admission rights of foreign nationals.</p>

star this property answer text <p>The proposal for local authorities to manage in-year admissions does not require primary legislation.</p><p>As part of the Schools White Paper, the department has committed to consulting on reforms the schools admissions framework including requiring local authorities to manage in-year applications, as well as applications in the normal round.</p><p>The department is working with stakeholders to refine our proposals. We will then carry out a full public consultation as required by statute when making changes to the School Admissions Code before implementing proposed changes to the code.</p> more like this
