star this property answer text <p>We are engaging with a number of authorities who are responsible for passported benefits to raise awareness of the Employment and Support Allowance underpayment exercise and the potential issues arising from it. This will enable Departments to understand the impacts on passported benefits they administer. DWP does not hold information on what people may or may not have claimed.</p><p>We will be reviewing all those cases potentially affected and paying any arrears of past payments that are due. Our focus is on paying arrears to claimants in line with the legislation. Where DWP administers the benefit we are ensuring that payment is made in line with regulations.</p> more like this

These schemes have a range of eligibility criteria and those affected by the ESA underpayment exercises may have qualified under alternative eligibility criteria.</p><p> </p><p>However, as part of the ESA underpayment exercise we are liaising with Ministry of Housing, Communities &amp; Local Government and we are informing Local Authorities of any new, past awards of income-related ESA in line with our business as usual procedures. This will support local authorities to consider further any possible impacts of the ESA underpayment exercise.</p> more like this

The Government is considering whether individuals being placed on contributory Employment and Support Allowance (ESA), rather than income-related ESA, may have impacted their eligibility for council tax support or council tax benefit and the levels of support granted to them. star this property answer text <p /> <p>As with all of our policies, we keep the operation of the sanctions system under review to ensure that it continues to operate effectively and as fairly as possible.</p><p> </p><p>We continue to make improvements to the sanctions system as committed to in our response to the Oakley Review. The Government has gone further than the scope of the Review, for example, we are reviewing all claimant communications and sanctions processes, not only for those Jobseekers Allowance claimants who come under the remit of the Review, but all Jobseekers Allowance claimants and also all Employment Support Allowance claimants.</p> more like this

star this property answer text <p /> <p>The Regulations that implement the measure making changes to how repeat claims for Employment and Support Allowance are dealt with were laid before Parliament on 5th March.</p><p> </p><p>The Regulations can be found at <a href="http://www.legislation.gov.uk/id/uksi/2015/437" target="_blank">http://www.legislation.gov.uk/id/uksi/2015/437</a>.</p><p> </p><p>The criteria for eligibility for the support group in Employment and Support Allowance remains the same for men and women.</p><p> </p><p>The updated guidance for healthcare professionals on the assessment of risk in claimants with a Mental Health condition was developed with input from senior psychiatrists. It differentiates between men and women in relation to suicide risk because the suicide rate in men is significantly higher than in women.</p><p> </p><p>The guidance makes clear that the assessment of risk needs to focus both on the claimant’s health and whether the claimant could cope with work-related activity.</p> more like this
