star this property answer text <p>Sentencing guidelines are not set by the Ministry of Justice. They are set by the independant Sentencing Council.</p><p>I can however confirm, new guidelines on sentencing under 18s for sexual offences came into effect in June.</p> more like this

star this property answer text <p>The average length of custodial sentence for rape, in England and Wales, from 2011 to 2015, can be found in the ‘Criminal Justice Statistics Quarterly: December 2015’ which can be found on Gov.uk.</p><p> </p><p>Rape carries a maximum penalty of a life sentence. Indeterminate sentences such as life sentences are specifically excluded from the average custodial sentence length calculation.</p> more like this

star this property answer text <p>The sentence of Imprisonment for Public Protection (IPP) was abolished in 2012. For those still serving the sentence, it is for the independent Parole Board to determine whether to release an IPP prisoner by considering the evidence presented and applying the statutory release test.</p><p>On 16 October 2023 the Lord Chancellor announced to the Parliament reforms to ensure that convicted rapists (and those convicted of the most serious sexual offences) must serve 100% of their custodial term in prison. These reforms will be legislated for in the Sentencing Bill. Since 2010, offenders convicted of rape are serving longer in prison, with sentences rising almost 3 years, from approximately 6.5 years in 2010 to approximately 9.5 years now – an over 40% increase.</p> more like this

star this property answer text <p>The Ministry of Justice has published information on prosecutions and convictions for rape and offences in England and Wales, up to December 2020, available in the ‘Outcomes by Offence’ data tool, which can be found here: <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/987715/outcomes-by-offence-2020.xlsx" target="_blank">https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/987715/outcomes-by-offence-2020.xlsx</a></p><p> </p><p>In order to isolate rape offences, type ‘rape’ into the ‘Offence’ filter and select all results that appear (19C-19H). Rows 55 to 77 will display a range of values based on sentence lengths.</p><p> </p><p>Rape and sexual violence are devastating crimes that have a long-lasting impact on victims. Provisions in the Police, Crime, Sentencing and Courts Bill, currently before Parliament, will ensure that all serious sexual offenders, including those convicted of rape, will be required to serve two-thirds of their sentence in prison if given a standard determinate sentence of more than 4 years.</p><p> </p><p>It is regrettable that you voted against this.</p>

star this property answer text <p>Information on the number of defendants who failed to attend court for their sentencing for PQ 117604 and 117605 is not centrally recorded in the Court Proceeding Database held by Ministry of Justice and to obtain it would involve a manual interrogation of court records which would result in a disproportionate cost to the department.</p><p>Prisoners who are ordered to attend their sentencing hearing and refuse to do so could be charged with a disciplinary offence resulting, for example, in forfeiture of privileges or additional days added to their sentence.</p> more like this
