star this property answer text <p>We have not made an assessment of the effectiveness of the Weeds Act 1959 across the UK. Natural England (the delegated authority for investigating complaints about injurious weeds) monitors compliance with the Act through the collection of data such as the number of enforcement notices issued per year.</p><p> </p><p> </p><p> </p><p>There were 37 enforcement notices in 2013. However, we encourage communications between landowners and complainants to try and resolve any issues informally. star this property answer text <p>The penalty for felling a tree without the authority of a felling licence is prescribed by section 17 of the Forestry Act 1967. A person guilty of this offence is liable on summary conviction to a fine not exceeding level 4 on the standard scale or twice the sum which appears to the court to be the value of the tree, whichever is the higher. The standard scale of fines was introduced into the Forestry Act by the Criminal Justice Act 1982.</p><p> </p><p>Changes to the standard scale are made the Ministry of Justice and apply uniformly across all offences using the standard scale. star this property answer text <p>The construction and demolition sector has made great strides in reducing the amount of waste that is sent to landfill. We are required to report on the recovery of construction and demolition waste across the UK, with a target of achieving a recovery rate of at least 70% by 2020. It is challenging to measure progress against this target and the methodology is being reviewed, but provisional estimates indicate that England is achieving a recovery rate that is comfortably above 70%, with the amount landfilled having decreased by over 40% between 2008 and 2012.</p><p> </p> more like this

star this property answer text <p>In 2008 the Competent Authority (CA) published the containment policy, a framework for upgrading existing fuel sites so far as is reasonably practicable. Upgrades are being prioritised at higher risk sites and where measures are aimed at preventing release of fuel from tanks. In order to avoid disrupting operations and supplies, the upgrading work is being phased. All necessary upgrades are expected to be complete by 2028.</p><p>The 87 fuel terminals and 7 refineries have already completed many of the high risk and low cost improvements required. Improvement plans for upgrading storage tanks at the fuel terminals have also been agreed with the CA and progress against plans is monitored on an annual basis. A new risk assessment method for the very large tanks at the oil refineries was agreed with the CA in October this year and the refineries will submit their upgrading plans for approval by March 2015.</p><p> </p> more like this

star this property answer text <p>Flowback fluids from hydraulic fracturing operations are deemed to be a mining waste and therefore require an environmental permit from the Environment Agency for temporary storage on site. Subsequent treatment and disposal of the fluid at a waste treatment facility is also regulated by the Environment Agency. Waste waters must be stored in sealed tanks on bunded storage areas. The storage of wastewaters in open lagoons, as has sometimes been practised in the US, would not be permitted in this country.</p><p> </p> more like this

star this property answer text <p>Concerns about any suspected contamination incidents, irrespective of source, should be raised with the Environment Agency via its incident hotline, details of which are available on the GOV.UK website.</p><p> </p><p> </p><p> </p><p>As far as fracking is concerned we have robust regulatory controls in place. Shale gas wells must be designed, built and operated to standards set in the regulations governed by the Health and Safety Executive, and the Environment Agency will not permit the use of substances hazardous to groundwater to be used in hydraulic fracturing where they may enter groundwater and cause pollution. Industry practice, underpinned by regulations, ensures monitoring will be required prior to, during and post-operation of the site.</p><p> </p><p><strong> </strong></p><p> </p><p>As with any activity, the Environment Agency can take enforcement action to prevent or remedy pollution of groundwater caused by the actions of operators.</p><p> </p><p> </p><p> </p> more like this

star this property answer text <p>In England, for the purposes of the Water Framework Directive and Groundwater Directive, the Environment Agency has the responsibility for making determinations of substances that may be hazardous in groundwater. It will not permit the use of ‘hazardous substances’ for any activity, including hydraulic fracturing, where they would or might enter groundwater and cause pollution.</p><p>Hazardous substances are defined as those that are persistent, bioaccumulative and toxic, or, for the Directives, where there are ‘equivalent levels of concern’. The Joint Agencies Groundwater Directive Advisory Group (JAGDAG) carries out peer reviews of these determinations, before recommendations are then put to public consultation. Substances that were proposed for use for hydraulic fracturing of shales in Lancashire have been assessed and were determined as non-hazardous. Authorisations include statutory conditions of use which must be followed to ensure that these products are used safely.</p><p> </p><p>National pesticides legislation subjects internet sales of pesticides to all the same legal obligations as over-the-counter sales. The Health and Safety Executive (HSE), as the UK pesticides regulator, follows up any concerns raised on internet sales with sellers where possible, to ensure internet sales comply with legal requirements. In order to support compliance with the law, the pesticides distribution sector has produced best practice guidance to raise awareness amongst distributors selling pesticides on the internet.</p> more like this

star this property answer text <p>LED lighting is considered as part of all building refurbishment projects and installed where investment over the projected life time of the building demonstrates value for money.</p><p> </p><p> </p><p> </p><p>In 2011, Core Defra’s HQ building, Nobel House, was refurbished and LED lighting installed, with Passive Infra-Red (PIR) daylight and motion sensors.</p><p> </p><p> </p><p> </p><p>Core Defra’s properties at York and Alnwick were refurbished in 2009 with energy efficient T5 fluorescent tube lighting with PIR daylight and motion sensors. LED lighting for office spaces was not considered value for money at that time. Future projects at these properties would consider upgrades to LED lighting.</p><p> </p><p> </p><p>The Core Defra estate has an estimated 40% LED lighting.</p> more like this

star this property answer text <p>The EU Timber Regulation (EUTR) prevents the trade of illegally-harvested timber in the EU by laying obligation on operators who place timber and timber products on the market, and those who subsequently trade in them. It was implemented in the UK by the Timber and Timber Products (Placing on the Market) Regulations in March 2013.</p><p>Independent assessments by the European Commission and WWF rank the UK’s efforts on tackling the trade in illegal timber and our domestic implementation of the EUTR as amongst the best in EU Member States.</p><p>To be fully effective in keeping illegally harvested timber and timber products out of the EU all Member States need to implement the EUTR. We are working closely with the Commission and other Member States on this and have offered to share the UK’s experience with them.</p><p>The review next year will provide us with an opportunity to improve the effectiveness of the EUTR.</p> more like this

The legislation applies to all timber and timber products in scope of the regulation, including illegally-harvested timber from the Brazilian Amazon.</p><p>In the UK, the National Measurement Office (NMO) is the competent authority for the EUTR. star this property answer text <p>Prospective landfill site operators must apply to the Environment Agency for an environmental permit under the Environmental Permitting (England and Wales) Regulations 2010.</p><p> </p><p>The Environment Agency will assess whether proposed operations can comply with the regulations. If it is satisfied, the Environment Agency will issue a permit, which will include conditions to ensure the operator complies with relevant legislation and manages its activities so that it does not cause pollution.</p><p> </p><p>Permits include limits on emissions of polluting substances to the wider environment. These include emissions:</p><p>• to groundwater;</p><p>• of landfill gas;</p><p>• that may affect amenity (e.g. noise, odour, dust, pests).</p><p> </p><p>To assess compliance with the permit, the Environment Agency:</p><p>• routinely visits landfill sites and meets with the operator;</p><p>• audits the operator’s management system and activities against the permit conditions and best practice;</p><p>• responds to complaints about the landfill site and monitors impacts on local communities where necessary;</p><p>• reviews and approves (or rejects) development plans;</p><p>• reviews reports required by the permit including the operator’s monitoring data and records of waste accepted.</p><p> </p><p>The Environment Agency takes action where it identifies non-compliance with permit conditions in line with its Enforcement and Sanctions Guidance.</p>

star this property answer text <p>We have not received any recent representation from park home owners on this topic.</p><p> </p><p>The majority of premises either receive their water and sewerage services from a water company or a reseller. A customer of a water company can request (under the Water Industry Act 1991) a water meter and if it is not feasible to fit one (due to it being impractical or unduly costly) they will be moved across to an assessed charge. The assessed charge should ‘bear as much relation as possible to the volumes of water such customers would be likely to use’ and are normally based on the average metered bill for the area or the number of bedrooms.</p><p> </p><p>Those customers of resellers (and this can include sheltered accommodation, housing association properties, flats above commercial premises, caravan parks and park homes) can ask for a meter to be fitted but there is no legal requirement on the reseller to do this.</p><p> </p><p>The industry regulator, Ofwat, regulates the resale market through The Water Resale Order 2006 (section 150 of the Water Industry Act 1991) and provides examples on how the charges should be apportioned.</p>

We are aware of a number of collaborative applications that will have multiple beneficiaries. These demonstrate particularly effective use of the grant.</p><p>The scheme is still running. All local authorities must claim reimbursement for grant payments from Defra by 31 March 2015. After then we will be better placed to assess the effectiveness of the scheme.</p> more like this

star this property answer text <p>The Government-funded New Dimension project saw the deployment of 50 High Volume Pumps (HVP) positioned across the country, with 46 allocated to 38 English Fire and Rescue Services and four in Scotland; an additional Strategic HVP was located centrally. There are four mobile HVPs in Wales. Under the Fire Rescue Service mutual aid arrangements Wales also have access to all of the strategic assets in England. The planning assumptions for a major incident involving man made or natural flooding, assumes a minimum of one HVP will be mobilised to respond to an incident within a maximum of two hours of request.</p><p> </p><p>The Environment Agency holds a range of strategic incident response supplies at its depots across England, including:</p><p> </p><p>· three 12 inch pumps</p><p> </p><p>· six24 inch pumps</p><p> </p><p>· 425 smaller mobile pumps</p><p> </p><p>· 3.8km of demountable and temporary flood defences</p><p> </p><p>· 21 sandbag machines</p><p> </p><p>The larger 12 and 24 inch pumps can be deployed within 24 hours. The Environment Agency also has access to a further six 24 inch pumps through its contracted suppliers.</p><p> </p><p> </p>

star this property answer text <p>Going into this winter every community that was affected by the storms and floods of last winter will have the same or better standard of protection as they had before last winter.</p><p>Following the tidal surge on 5 December 2013 and the winter storms, a total of 890 recovery projects were identified across England; of these, 844 projects involved the repair of flood defence assets. The remaining 46 involve surveys, studies or actions relating to incident response.</p><p>By 31 October 2014, permanent repairs had been completed for 802 (95%) of the 844 defence projects. There are 42 (5%) defence projects where temporary repairs with contingency measures are in place, restoring the standard of protection to pre-winter 2013/14 levels.</p><p> </p><p> </p><p> </p><p> </p> more like this

star this property answer text <p>The Committee on the Medical Effects of Air Pollutants (COMEAP) advises the Government on all matters concerning the health effects of air pollutants. COMEAP has previously assessed the effects of long-term exposure to air pollution on mortality. It has also assessed mortality effects from particulate matter specifically, which included an assessment for London. The reports are available at: <a href="https://www.gov.uk/government/collections/comeap-reports" target="_blank">https://www.gov.uk/government/collections/comeap-reports</a>.</p><p> </p><p> </p><p> </p><p>Mortality attributable to particulate air pollution is included in the Public Health Outcomes Framework, used to assess progress by local authorities in addressing this health issue.</p><p> </p> more like this

star this property answer text <p>Evidence on the availability of flood insurance has been provided and considered by Defra at various stages, including during the passage of the Water Act 2014 through Parliament and following the Downing Street Floods summit on 18 February.</p><p>I met representatives of small businesses in June to listen to their concerns and to provide an outline of our plans for market monitoring. Findings of the Defra research contract will be published next year. I intend to have another meeting when this work is completed.</p> more like this

star this property answer text <p>We are committed to completing the coastal path around England by 2020. As announced by the Deputy Prime Minister, extra funding will be made available and we are discussing this with HM Treasury.</p><p>To date, Natural England has incurred establishment costs of £137,238 on the three stretches of the coast where the right of access under the Marine and Coastal Access Act 2009 has been implemented. Natural England has estimated further establishment costs of £851,730 on the six stretches where it has submitted coastal access reports to the Secretary of State, but where the right of access has not yet been implemented.</p><p>Natural England's staff costs for delivering costs coastal access are included within its overall staff budget. Natural Englad is also incurring additional costs for publishing and advertising coastal access reports, and for agreements which it has entered with access authorities to provide it with a range of access advice and to carry out preliminary work in relation to the coastal path.</p><p>The Department has spent £85,590 in meeting the costs incurred by the Planning Inspectorate in determining a number of objections which have been made to proposals in Natural England's coastal acces reports.</p>
