NHS England is working alongside ICBs to ensure that delegation agreements are in place, including ensuring appropriate collaborative arrangements are developed to support ICB commissioning of specialised services. These arrangements will be monitored by NHS England through its assurance processes for specialised services.</p><p>On 28 March 2024, the NHS England Board approved the recommendation that the 32 specialised services listed in Annex A of Item 7 of Specialised Commissioning: update on specialised services for delegation, would be retained by NHS England.</p><p>Regardless of delegation status, NHS England will remain the accountable commissioner for the entire portfolio of specialised services, and as part of this role, will monitor the effectiveness of delegation and the lists of services. It should be noted that NHS England does have the ability to bring a service back under national commissioning control, under the safeguards put in place to support delegation.</p><p>All specialised services, whether retained or delegated, must comply with nationally developed standards, including service specifications and clinical commissioning polices. ICBs will be able to use specialised services funding to transform and develop services and pathways across their core and specialised responsibilities, to improve quality of care and equity of access and value, whilst also complying with national standards.</p><p>Whilst delegation is not an end in itself, moving to ICB-led commissioning supports a focus on population health management across whole pathways of care, and gives ICBs the powers they need to improve the quality of services, tackle health inequalities, and ensure best value. NHS England set out in detail the benefits of greater ICB involvement in the commissioning of appropriate specialised services in the Roadmap for Integrating Specialised Services within Integrated Care Systems, and subsequent board papers. During 2024/25, specialised services commissioning teams will remain employed by NHS England. Throughout the process, there was careful joint planning and progress monitoring between NHS England and the Department. All 42 ICBs were legally established on 1 July 2022 with no significant transition issues reported.</p><p>There are no plans to publish additional guidance, however the Department, via the National Institute for Health and Care Research Policy Research Programme, has recently commissioned an independent research study to evaluate the implementation of the Health and Care Act 2022.</p><p>The study aims to understand the different ways that partners within Integrated Care Systems, namely ICBs, integrated care partnerships, and wider system partners) are coming together to design, commission and deliver services, fulfil their duties, and the potential impacts. All study outputs, including interim reports, will be published. 	answer	answer is ministerial correction date of answer 03/07/2023 answer text <p>The Health and Care Act 2022 established integrated care boards (ICBs) and sets out a specific duty for ICBs in Section 14Z35 to reduce inequalities. It states that each ICB must, in the exercise of its functions, have regard to the need to reduce inequalities between persons with respect to their ability to access health services, and reduce inequalities between patients with respect to the outcomes achieved for them by the provision of health services.</p><p>ICBs and its partner trusts are also expected to seek the views of underserved groups during formulation of their Joint Forward Plans.</p><p>NHS England has a legal duty to annually assess the performance of each ICB and publish a summary of its findings. In undertaking this assessment, NHS England will consider how successfully each ICB has discharged its duties set out by the Act including the duty as to reducing inequalities. The annual assessment for 2022/23 is expected to be completed by end of July 2023 and will be shared with ICB chairs. ICSs bring together a wide range of partners to help plan and deliver well-joined up care and to ensure that population health needs are met.</p><p> </p><p>Within ICSs, integrated care boards (ICBs) are responsible for planning healthcare services and have a duty to reduce inequalities between persons with respect to their ability to access health services and to reduce inequalities between patients with respect to the outcomes achieved for them by the provision of health services. Furthermore, when planning healthcare services, ICBs must also have due regard to the Integrated Care Strategy. 	answer	answer is ministerial correction date of answer 30/05/2023 answer text <p>The NHS Act 2006, as amended by the Health and Care Act 2022, is clear that integrated care boards (ICBs) must make arrangements to ensure patients and the public are involved in the planning of commissioning arrangements or changes to those arrangements. Arrangements for public involvement, and principles for their implementation, must be set out in the constitution of the ICB. In addition, membership on the boards of integrated care partnerships typically includes Healthwatch and public representatives.</p><p>Whilst the Government is clear about the importance of patient and public involvement, it is permissive in how this is achieved. Integrated care boards (ICBs) are responsible for producing a five year joint forward plan with their partner trusts, foundation trusts, local authorities and other members. This plan should have regard to the integrated care strategy produced by the integrated care partnership (ICP). We are aware of 35 integrated care strategies that have been produced by ICPs in England.</p><p>We committed in the integration white paper ‘joining up care for people and places’ to review, and where necessary simplify, pooled budget arrangements to promote further integrated funding arrangements. Instead, we recognise that ICSs require the right level of autonomy to develop strong relationships and common culture which will progress healthcare planning and delivery in their communities.</p><p>The structures put in place by the Health and Care Act 2022 help ICSs make these changes more easily.
