	answer	answer is ministerial correction date of answer 08/05/2019 answer text <p>Personal budgets (particularly direct payments) are designed to be used flexibly and innovatively and so there should be no unreasonable restriction placed on the use of the payment, as long as it is being used to meet eligible care and support needs in line with the care and support plan agreed between those requiring care and their local team which includes healthcare professionals. The local authority then has a duty to ensure that their care meets the needs of the eligible person, and to continue to oversee that care to ensure it addresses the identified needs.</p><p>The Department does not make specific recommendations on what should be included in care and support plans, nor do we require local authorities to identify the role of companion animals. Instead, there are exclusions listed within the regulations. The issue was highlighted by the Competition and Markets Authority (CMA) in the final report of their care home market study published on 30 November 2017.</p><p> </p><p>It is right that the CMA is taking enforcement action where appropriate and we welcome that the CMA will provide guidance on consumer law for the adult social care sector. However, it would be inappropriate to introduce a blanket ban on 15 minute homecare visits. They may be appropriate in certain circumstances, for instance, checking a person’s medication has been taken.</p><p> </p><p>Ultimately, local authorities are responsible for the commissioning of services. We are supporting local authorities to improve commissioning of care.</p><p> </p><p>The Department has also worked with local government and the care sector to develop and encourage good practice in commissioning and managing local adult social care markets. A suite of guidance is now available at the on-line Hub on GOV.UK.</p><p> </p><p>The Department is working with organisations from across the adult social care sector to implement Quality Matters – a shared commitment to take action to achieve high quality social care.
