The maintenance calculation will be based on information held by HM Revenue &amp; Customs (HMRC) about their earnings for the most recent complete tax year.</p><p> </p><p>Access to income information reported by HMRC allows us to capture a much wider range of income types received by paying parents, including income from property, savings and investments (including dividends) and other miscellaneous income. Child Maintenance in Northern Ireland is a devolved issue, although they run a broadly similar scheme. Any questions should be directed to the Department for Communities in Northern Ireland.</p><p> </p><p>We support separated parents to make their own family based arrangements wherever possible. This allows families to create flexible arrangements that work for their individual circumstances and, where parents are able to work together, this can be better for their children. Where this is not possible, the CMS offers an effective and efficient statutory scheme for those parents who really need it.</p><p> </p><p>Under the statutory scheme, where paying parents fail to pay on time and in full, we aim to take immediate action to recover the debt and re-establish compliance. 	answer	answer is ministerial correction date of answer 23/05/2019 answer text <p>A welcome pack is issued to each new employer which is followed up with a telephone call to a specific person in payroll to check they understand the Deductions from Earnings Order (DEO) process and the employers obligation, to deduct payments on time from employee salary. Each month thereafter, a target schedule is sent to the employer’s payroll department.</p><p> </p><p>For existing employers a target schedule is also sent and a phone call will have taken place when we initially requested deductions to be taken.</p><p> </p><p>If employers don’t make the payment to CMS on time we will call that employer 5 working days after the missed payment to investigate late payment and re-iterate their obligations to CMS.</p><p> </p><p>Where employers repeatedly fail to send payments, we will work with them to understand what we need to do in order to reach compliance. At this point we also work alongside our Financial Investigations Unit, where we might consider a face to face visit to the employer is appropriate. Where a non-resident parent fails to pay on time or in full, we aim to take immediate action to recover the unpaid maintenance and re-establish compliance.</p><p> </p><p>Where compliance is not achieved and the non-resident parent is employed we will attempt to deduct their maintenance (and/or any arrears) direct from their earnings via a deduction from earnings order. We received a total of 99 responses, 11 from organisations and 88 from private individuals (of which 21 identified themselves as paying parents, and 24 as receiving parents). Respondents were asked 15 question, four of which discussed the proposal to write off historical arrears.</p><p>Accurately assessing the number of responses opposed specifically to the proposal to write off historical arrears is not straightforward. Not all respondents chose to answer the specific questions, and a large number of responses were about individual case circumstances, and didn’t raise issues within the scope of the consultation. Those who do not receive their maintenance in full and on time, should contact the CMS straight away, so the case can be moved into the Collect &amp; Pay service to enforce regular payments of ongoing maintenance and arrange collection of arrears.</p><p> </p><p>For clients using the Direct Pay service a payment schedule is issued, detailing the maintenance and arrears due to be paid. It is clearly explained to both parents that they will be responsible for managing their payments and keeping appropriate records of the child maintenance payments made.</p><p> </p><p>At the start of every case, and at each annual review, parents are notified what to do if their arrangement breaks down. The CMS sends SMS messages to parents using Direct Pay three months after they set up their arrangement to remind them to contact the Service if their arrangement is not working.</p><p> </p><p>The importance of full and on time payments is emphasised to clients by CMS caseworkers and Child Maintenance Options call handlers. The Department does hold information regarding:</p><ol><li>deductions from the benefits received by a paying parent on the Child Maintenance Service in order to pay Child Maintenance;</li><li>instances in which the details of non-compliant paying parents on the Child Maintenance Service have been shared with credit reference agencies.</li></ol><p>The Department has no immediate plans to publish this information.
