These arrangements are agreed by officials in consultation with our external partners. However, it is normal practice for most of our external partners to have their own support arrangements in place for their staff.</p><p> </p><p>Prison staff not directly employed by HMPPS do not have access to all occupational health services because occupational health is the responsibility of their employer.</p><p> </p><p>However, contractors and third party supplier staff do have access to a 24 hour body fluid exposure and sharps injury help line, which gives non-directly employed prison staff access to immediate and specialist advice and guidance from a nurse following a suspected and actual body fluid exposure incident. There is a wide range of procedures and systems in place across the estate to control and mitigate their exposures to the risk referred to.</p><p> </p><p>Guidance was issued in 2017 on the control of secondary exposure and scientific research into the risk commenced in May 2018 and is currently focused on post-exposure testing of staff across ten prisons. It has been agreed that the testing programme will be expanded to include a further 10 prisons.</p><p> </p><p>Violence against those working in prisons will never be tolerated. The Assaults on Emergency Workers (Offences) Act received Royal Assent on 13 September and came into force on 13 November. This will increase the penalty, from 6 to 12 months, for those who assault emergency workers including prison officers. This is an integral part of the HMPPS Health, Safety and Fire risk management system</p><p> </p><p>In terms of emotional and social staff support, prison staff not directly employed by HMPPS can have access to the Employee Assistance Programme (EAP), trauma support services and personal well-being zones. The EAP 24/7 helpline is accessible confidentially and without the need for line manager referral. The helpline provides access to counselling for work or non-work related issues, legal and consumer advice, as well as support for managers in handling of sensitive situations. These can all aid emotional and social well-being for not directly employed staff in prisons</p><p> </p><p>Violence against those working in prisons will never be tolerated. Risks to staff are continually assessed, and suitable controls are implemented accordingly. The effectiveness of those controls is monitored at local and national level, and through joint audit work with prison unions.</p><p> </p><p>HMPPS recognises that the physical, emotional and social wellbeing of employees is paramount. All HMPPS staff have access to an occupational health service and employee assistance programme. This includes 24 hour, 365 days a year access to signposting and counselling, and trauma support services.</p><p> </p><p>It is a priority to ensure that prisons are places of safety and reform and the government has invested an additional £70 million investment in safety, security and decency. A comprehensive occupational health service and employee assistance programme is available to all staff and systems are in place to deal with perpetrators of violence against staff quickly and robustly. Safety remains a top priority and we recently changed the law to double sentences for those that attack our hardworking staff. New and enhanced technology as well as dedicated search teams have contributed to that fall in the smuggling of weapons.</p><p> </p><p>The new Crime in Prison Agreement between HMPPS, the Crown Prosecution Service (CPS) and the police has also resulted in crimes committed whilst in prison or in smuggling in illicit items being consistently referred for prosecution to the police. This sends a clear message to those who commit crimes that they will be punished through the courts and face the consequences of their actions</p><p> </p><p>Data on weapons held in prison has been collectively systematically since 2015 and is enclosed. If the employee is advised to attend A&amp;E this signifies that the body fluid exposure is high risk and medical assessment by A&amp;E is required to obtain blood for serum save and to assess suitability for post exposure prophylaxis and/or Hepatitis B injection.</p><p> </p><p>Should Post Exposure Prophylaxis (PEP) be required, the member of staff will call the Body Fluid Exposure and Sharps Injury helpline with details of treatment they have received. Follow up testing for Blood Borne Virus (BBV) is provided for all injured staff to determine if they have contracted a BBV, however, staff are not required to report if they have contracted a blood borne virus at work and the data is therefore it is not possible to report data with any certainty.</p><p> </p><p>If an employee were to contract a Blood Borne Virus from an occupational exposure and had reported this to the Body Fluid Exposure and Sharps Injury helpline (provided by HMPPS’ Occupational Health supplier Optima Health) then HMPPS are required to be made aware under RIDDOR (Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013) with the employees consent. 	answer	answer is ministerial correction date of answer 15/07/2019 answer text <p>We are taking urgent action to tackle violence in prisons, alongside reforms to overhaul the system to focus on the rehabilitation of offenders. Investment in additional prison officers and the introduction of Keyworkers enables prison officers to mentor, challenge and support a small caseload of prisoners away from violence and reoffending. The Challenge, Support and Intervention Plan (CSIP) has, since November 2018, been mandated for use in all establishments. CSIP provides a case management model to help staff to manage violent prisoners and those identified as posing a raised risk of being violent. Violence against our staff is unacceptable. The Assaults on Emergency Workers (Offences) Act came into force on 13 November which has increased the penalty – from 6 to 12 months - for those who assault emergency workers including prison officers.</p><p> </p><p>In order to improve support for prisoners with mental health needs, we have rolled out improved suicide and self-harm prevention training and over 25,000 new and existing prison staff have completed some of this training. We have also awarded the Samaritans a grant of £500,000 each year for the next three years, to continue to support the Listeners’ scheme. For those prisoners requiring transfer to secure hospitals for mental health treatment, we are working collaboratively with Her Majesty’s Prison and Probation Service (HMPPS), Department of Health and Social Care (DHSC) and NHS England (NHSE) to improve the transfer process. On 20<sup>th</sup> June we also announced the development of a Health and Justice Plan which will bring together a coherent, holistic picture of the full offender health journey, from the point of arrest through to release.</p><p> </p><p>Our Drugs Taskforce is working with law enforcement and health partners across government to restrict the supply of drugs, reduce demand and build recovery from substance misuse through the national Prison Drugs Strategy. We have invested £70 million to improve safety, security and decency, allowing us to fund new security scanners, improve searching techniques, and introduce phone-blocking technology. We have made it a criminal offence to possess psychoactive substances in prison and trained more than 300 sniffer dogs to detect these drugs. We recognise the importance of this support and have made changes so that Community Rehabilitation Companies (CRC) are clearly responsible for the provision of identification documents and bank accounts, as part of Through the Gate support to prisoners on release. We have invested an additional £22 million per annum to improve delivery of these vital services for the remainder of the CRC contracts.</p><p> </p><p>The Department for Work and Pensions (DWP) has responsibility for Universal Credit and Jobcentre appointments. We are working closely with the DWP to agree a National Partnership Agreement which sets out how the two Departments work together to support ex-offenders into employment. 	answer	answer is ministerial correction date of answer 11/07/2019 answer text <p>Non-payment of council tax is not a criminal offence and cannot attract a custodial sentence.</p><p> </p><p>Committal to prison can only ever be the last resort for non-payment of council tax. Before a magistrates’ court commits someone to prison for failure to pay their council tax, it must have issued a “liability order” and the local authority must have (at least) tried and failed to take control of the debtor’s goods and sell them to recover the debt. Councils have additional powers of enforcement under a liability order, including deduction from earnings, deduction from benefit, charging orders on the property, and bankruptcy. If a council applies for committal to prison, the court must inquire into the debtor’s means, and the council must satisfy the court that there is no other effective method of collection and that failure to pay is due to wilful refusal or culpable neglect. This is to prevent persons who are genuinely unable to pay their council tax from being committed to prison. The deployment of staff between prisons on National Detached Duty is a regular and normal part of prison resourcing; the number of Prison Officers deployed on National Detached Duty varies from one week to the next in order to reflect operational circumstances.</p><p> </p><p>The attached table shows the number of staff deployed through National Detached Duty to the prisons rated as being of serious concern in the Annual Prison Performance Ratings 2017-18 for the last six months of 2017 and 2018. Figures are not included for HMP Peterborough as privately managed prisons are not supported with National Detached Duty. It should be noted that the figures represent the number of staff in place during the week commencing the date shown, it is not known how many days per week that staff would have been deployed. The prisons in the 10 Prisons Project are: Hull, Humber, Isis, Leeds, Lindholme, Moorland, Nottingham, Ranby, Wealtsun, Wormwood Scrubs.
