star this property answer text <p>NHS England is engaging with the National Institute for Health and Care Excellence (NICE) on the Highly Specialised Technologies evaluation of human alpha1-proteinase inhibitor for treating emphysema in adults with documented severe alpha1 antitrypsin deficiency. NICE has not yet published final guidance and recently consulted on its draft guidance.</p><p> </p><p>NICE’s evaluation committee is due to meet again to consider its recommendations in spring next year. This is to enable the company that makes the alpha1-proteinase inhibitor to prepare and submit additional information for consideration by the committee. Once NICE guidance is received, NHS England will then consider the commissioning implications in consultation with the Specialised Respiratory Clinical Reference Group.</p> more like this

star this property answer text <p>The Specialised Respiratory Clinical Reference Group (CRG) is maintaining an oversight of the need to develop a service specification and selection of providers to offer specialised expertise and management advice for patients diagnosed with alpha1 antitrypsin deficiency (AATD).</p><p> </p><p>The CRG has recommended that NHS England wait until it is clear on the outcome of the National Institute for Health and Care Excellence (NICE) Highly Specialised Technologies evaluation of human alpha1-proteinase inhibitor for treating emphysema in adults with documented severe AATD [ID856] until this development is taken forward.</p><p> </p><p>NICE has not yet published final guidance and recently consulted on its draft guidance. NICE’s evaluation committee is due to meet again to consider its recommendations in spring next year. This is to enable the company that makes the alpha1-proteinase inhibitor to prepare and submit additional information for consideration by the committee.</p> more like this

star this property answer text <p>Age is a protected characteristic in the Equality Act 2010. Where differential treatment because of age cannot be objectively justified, this will constitute unlawful age discrimination both in employment and in the provision of goods and services. Enforcement of the Act’s employment provisions is undertaken by Employment Tribunals, to which a person must make a claim if they feel that they have been discriminated against because of age.</p><p>Prior to an Employment Tribunal claim, conciliation services are provided by the Advisory, Conciliation and Arbitration Services (Acas). According to the Employment tribunal statistics, 1,087 age discrimination claims were made to Employment Tribunals in 2014/15. 70% (761) of these claims were either withdrawn or successfully conciliated by Acas without the need for a full hearing. The Acas process is intended to enable employers and employees to resolve disputes without the need for a full Employment Tribunal hearing.</p><p>The Equality and Human Rights Commission’s enforcement powers under the Equality Act 2006 apply to age discrimination as they do to other protected characteristics.</p>

star this property answer text <p>The Care Quality Commission (CQC) rated Alder Hey Children’s Hospital as good overall following an inspection in June 2015. A responsive inspection was carried out in April and May 2017 but this did not alter the hospital’s current overall rating.</p><p> </p><p>The CQC regulates and assesses all providers of regulated activities by looking at five domains – whether they are safe, effective, caring, responsive to people’s needs and well-led. Alder Hey Children’s Hospital was rated as good under the safe, effective, responsive and well led domains and outstanding for caring.</p><p> </p><p>It is not appropriate for the Department to comment on the specific circumstances relating to individual cases.</p> more like this

star this property answer text <p>In line with the requirements of the Public Contracts Regulations 2015 DWP uses a range of selection and exclusion criteria to avoid awarding contracts to unsuitable suppliers.</p><p>The mandatory exclusion criteria includes any supplier convicted of the common law offence of &quot;cheating the Revenue&quot; and/or &quot;fraudulent evasion&quot;. Suppliers with a relevant conviction are excluded from the competition.</p><p>Suppliers will also be excluded where the Department has evidence of a breach of obligations relating to the payment of taxes or social security contributions which has been established by a judicial or administrative decision in accordance with UK law.</p><p>The discretionary exclusion criteria includes the option to exclude a supplier where the Department can demonstrate by appropriate means that a supplier is in breach of obligations relating to the payment of taxes or social security contributions (in lieu of a formal judicial or administrative decision).</p><p>DWP Standard Terms &amp; Conditions also include provisions that require suppliers to notify the Department of any Occasions of Tax Non-Compliance or any litigation they are involved with that is connected to any Occasion of Tax Non-Compliance.</p><p>The Department can terminate the contract in the event that the supplier:</p><ul><li>Has misrepresented Occasions of Tax Non-Compliance in its warranty to the Department</li><li>Fails to notify the Department of an Occasion of Tax Non-Compliance</li><li>Fails to provide details of acceptable mitigation of an Occasion of Tax Non-Compliance.</li></ul><p>The Department does not keep a central record of suppliers who are excluded from procurement competitions due to avoiding or evading tax liabilities. In fact suppliers are encouraged to self-regulate by deselecting themselves from the competition when they become aware of the exclusion criteria.</p><p>The Department does not keep a central record of suppliers who report Occasions of Tax Non-Compliance during the lifetime of the contract. These are addressed by the contract manager in each case in accordance with the Terms &amp; Conditions of the contract.</p>

star this property answer text <p>The Department has a carers policy for staff who work in the Department.</p><p> </p><p>The Department recognises that care responsibilities are not static and is committed to supporting staff who have caring responsibilities away from the workplace. The caring commitments of staff may be long or short term.</p><p> </p><p>Other steps taken to support employees with caring responsibilities:</p><p> </p><p>The Department has a number of provisions available to its staff including paid special leave; emergency carer leave; unpaid career breaks.</p><p> </p><p>The Department operates a recently updated flexible working policy which can support those with caring responsibilities by giving some degree of flexibility on how, where and when employees work. It includes a range of working patterns including: part-time, job share, remote/ home working, compressed hours, part-year, annual hours and flexi-time. It also outlines support to managers on how to have conversations about flexible working. It also makes it clear to staff how they can raise a request or initiate a conversation.</p><p> </p><p>On the Departmental intranet site there are links to relevant sources of support and useful websites. Special events are publicised on the intranet including the campaign to help carers by the Charity for Civil Servants which was launched on ‘Carer’s rights day’ last November.</p><p> </p><p>The Department launched an employee assistance programme in October 2017, which gives all staff access to confidential, independent, professional information, counselling and emotional support.</p><p> </p><p>During Carers Week in June 2017, the Department highlighted a number of ways that carers could receive support including the carers passport provided by the Charity for Civil Servants.</p>

star this property answer text <p>The Department contracts with EMCOR UK for cleaning services. Third party cleaning contracts are in place between EMCOR UK and Active clean, KEF and Churchills in delivering cleaning services within the Department’s buildings. The Department does not have the rates of pay of the third-party service providers.</p><p> </p><p>All service providers comply with the law in respect of the National Minimum Wage, but, in line with Cabinet Office advice, the Department and its executive agencies do not require their contracted companies to pay their employees the Living Wage as defined by the Living Wage Foundation.</p><p> </p><p>Public Health England contracts directly for cleaning services across five sites with three suppliers – EMCOR UK, Minster and Corporate Service Management. There are currently 28 individuals that they believe are paid below the Living Wage Foundation rate.</p><p> </p><p>The Medicines and Healthcare Products Regulatory Agency contracts directly for cleaning services across two sites with four suppliers- Interserve, Churchill, Pharmacleanse and Micronclean (Specialist Cleaning Services). Micronclean have 209 employees on a gross hourly rate of less than £9 which is less than the Real Living Wage.</p>

star this property answer text <p>Clinical commissioning groups (CCGs) determine the level of National Health Service-funded hospice care locally and are responsible for ensuring that the services they commission meet the needs of their local population. CCGs are best placed to understand local needs and to fund services to meet those needs from the overall resource allocations they receive.</p><p> </p><p>Health Education England’s (HEE’s) role is advising the health care system to ensure a sufficient supply of registered nurses are in the labour market, from which palliative care nurses can be drawn. HEE does not specifically plan for the numbers of palliative care nurses. Palliative care training is a professional development activity that is often funded by employers. This specialism is open to registered nurses. HEE has worked with partners at a national and Cancer Alliance level to develop Stage 1 of the Cancer Workforce Plan. This stage has focused on the supply issues related to seven occupations who are central to cancer care.</p><p> </p><p>Reforms to healthcare education funding that started to take effect from 1 August 2017 have unlocked the cap which constrains the number of pre-registration nursing, training places allowing students to gain access to nurse degree training courses. To support this, we announced additional clinical placement funding to make available 5,000 more training places each year from September 2018.</p>
