<p> </p><p>Only 4 TOCs (Arriva Trains Wales, Chiltern, First TransPennine Express
& Virgin Trains) have financial incentives for performance, based on formulaic
contractual payments from the Department for Transport (DfT) to the Train Operating
Company (TOC) for performance above a set level benchmark, and from the TOC to the
DfT for performance below it. The amounts paid are commercially confidential.</p><p>
</p><p> </p><p> </p><p>The Office of Rail Regulation (ORR) agrees track access contracts
between Network Rail and train operators. These track access contracts provide for
Network Rail to pay compensation to an operator in the event that train services cannot
operate or are delayed due to late running engineering works or unplanned disruption
outside that operator’s control.</p><p> </p><p> </p><p> </p><p>ORR publishes the annual
totals of these payments (referred to as Schedule 8 payments) at route level on its
data portal. The data comes from Network Rail’s regulatory financial statements.</p><p>
