star this property answer text <p>The Extradition Act 2003 is the legislative framework which contains the safeguards and protections available in UK courts to all persons requested for extradition to any overseas jurisdiction.</p><p>A requested person will not be extradited if doing so would breach their human rights (including the right to a fair trial) if the request is politically motivated, or if they would be at risk of facing the death penalty. The court can also bar a person’s extradition if, according to a range of factors, including their health, it would not be in the interests of justice for the extradition to take place and can decide that it would be more appropriate to try the case in the UK than in the requesting state.</p><p>Additionally, a person cannot be surrendered if extradition would be disproportionate, or if they are likely to face long periods of pre-trial detention. These protections are also enshrined in our new extradition arrangements with the EU under the Trade and Cooperation Agreement.</p>

star this property answer text <p>The Government strongly supports INTERPOL in its efforts to improve the safeguards it has in place to protect human rights and preclude interventions or activities of a political, military, religious or racial character. The Government views any allegation of misuse of INTERPOL’s systems very seriously and works closely with INTERPOL to ensure the legitimacy of the Red Notice system.</p><p>All Red Notices are subject to review by a multidisciplinary Notices and Diffusions Task Force in INTERPOL prior to publication to ensure legal compliance and prevent abuse of INTERPOL systems. In November 2019 the Home Office seconded a senior lawyer to INTERPOL to support the work of the Taskforce.</p><p>The UK is committed to the principle of non-refoulement and has repeatedly called on other countries to respect their obligations not to force persons to return to a country where there are substantial grounds for believing they would be in danger of being subjected to torture.</p> more like this

star this property answer text <p>It may assist if the following is explained.</p><ul><li>The Home Office processes extradition requests from non-EU territories for individuals believed to be in England and Wales, and Northern Ireland under Part 2 of the Extradition Act 2003.</li><li>The Crown Office &amp; Procurator Fiscal Service processes requests for individuals believed to be in Scotland.</li><li>The National Crime Agency processes extradition requests from EU Member States under Part 1 of the Extradition Act 2003 and data relating to these requests is published annually on the NCA website.</li></ul><p>Thus, the arrest of an individual sought for extradition would take place in the territory to which a request has been sent. If extradition is to proceed, after the legal process has concluded, and extradition is to proceed, the individual will be extradited to the territory which made the request. star this property answer text <p>The Extradition (Provisional Arrest) Act 2020 (‘The Act’) provides UK law enforcement agencies with the power of arrest on an international arrest alert (typically in the form of an Interpol Notice) which has been certified by the National Crime Agency. The Act was amended at Third Reading in the House of Commons on 8 September to add EU Member States to the Schedule of countries within scope of this power.</p><p>The Act will be commenced at the end of the Transition Period and its provisions were drafted to allow commencement for the EU Member States only should it prove to be necessary and not if there is an agreement which provides for the continuation of a warrant-based system after 31 December.</p> more like this
