Although local level Youth Offending Services have the ability to collect data on children’s nationality using their case management systems, it is unknown how many actually do record this information because the Youth Justice Board do not collate data on nationality centrally. star this property answer text <p>Youth Offending Services (YOS) were established in the Crime and Disorder Act 1998, which introduced a statutory duty for all local authorities to establish a multi-agency team, with members from police, social services, probation and education, to deliver youth justice services. YOS have a statutory duty to:</p><ul><ul><li>provide appropriate adults for children detained or being interviewed at the police station and provide support for children on bail;</li><li>help young people and their families through court proceedings;</li><li>write pre-sentence reports for the courts advising on appropriate interventions;</li><li>supervise young people serving a community sentence;</li><li>stay in touch with a young person if they’re sentenced to custody; and</li><li>assist in the child’s resettlement post-custody.</li></ul></ul><p>All children who come into contact with the YOS (including EEA nationals) will have their individual circumstances and needs assessed and will receive interventions and support accordingly.</p>

star this property answer text <p>It can be a difficult time when parents decide to separate but it is important that they are supported to make child-focused decisions in a way that minimise conflict and, importantly, are in the best interest of the child.</p><p> </p><p>The Government believes that, in cases where is it safe and appropriate, there are a range of services, such as mediation or other forms of non-court dispute resolution, that can provide parents with a constructive and less adversarial alternative to court proceedings.</p><p> </p><p>We will continue to consider options to enable parents to receive the services that are right for them and raise awareness of alternatives to court.</p> more like this

star this property answer text <p>The Government has no plans to reopen the pleural plaques compensation scheme, which operated between 2 August 2010 and 1 August 2011.</p><p> </p><p>The scheme operated as an extra-statutory one, making £5000 payments on an ex-gratia basis to applicants who fulfilled the scheme’s criteria, namely that they were individuals who had begun, but not resolved, a legal claim for compensation for pleural plaques at the time of the House of Lords ruling in October 2007 in the case of Rothwell v Chemical &amp; Insulating Co Ltd [2007] UKHL 39. That ruling had held that the occurrence of pleural plaques is not a compensatable disease.</p><p> </p><p>Eligibility for the scheme was limited to that category of people as they would have had an understandable expectation of receiving compensation when they began their claim, an expectation which would not have been shared by those diagnosed later.</p> more like this

star this property answer text <p>The Legal Aid Agency monitors the number of applications for public funding, as opposed to the number of discrete individuals who have received legal aid; one person may apply for legal aid on more than one occasion.</p><p>The figures below show the number of applications received and those subsequently granted for Civil Representation by providers located within the York Local Authority area. Please note that location data is based upon the solicitor’s office, rather than the address of the applicant. Individuals who reside within York may choose to access legal aid at a firm based in another location, and vice versa.</p><p>Where an application is ‘not granted’, this may be for a variety of reasons, including administrative (e.g. where information is missing or forms are not signed), or where the applicant does not meet the legal or financial tests to be eligible for public funding.</p><p>Solicitors are responsible for decisions on whether to grant funding under the ‘Legal Help’ scheme of civil legal aid, and therefore data on unsuccessful applications for this type of public funding are not available. star this property answer text <p>Legal aid is available for advice and assistance for all inquests, subject to a means and merits test. Inquests follow an inquisitorial process and legal aid support for representation is not typically applicable. Exceptional Case Funding may be available where certain inquests require legal representation. The Government wants to ensure that the bereaved are placed at the heart of the inquisitorial process and is taking forward a number of measures announced in the recent Review of Legal Aid for Inquests to make the inquest process more sympathetic to the needs of bereaved families; the Government also has work underway looking at the prevention of deaths of people who are in the care of the state.</p> more like this

star this property answer text <p>The Government announced the review of the legal aid means test on 7 February 2019, as part of the Legal Support Action Plan.</p><p>The review will consider the full range of means-testing criteria including the applicable thresholds for legal aid entitlement and their interaction with wider criteria.</p><p>The review is in progress, bringing together data, evidence and expertise, and liaising with experts from across the field to explore potential improvements to the system.</p><p>This comprehensive review of the legal aid eligibility regime is expected to conclude in summer 2020 after which we will publish a full consultation paper setting out our future policy on the proposals in this area. We will seek to implement any final recommendations as soon as practicable following public consultation.</p> more like this

star this property answer text <p>The Government is clear that there are sufficient solicitors to undertake criminal legal aid-funded cases and will make sure this continues to be the case in (a) the North West, (b) Merseyside, (c) Wirral and (d) Wallasey. The Government commenced a review of all criminal legal aid fee schemes in December 2018, including the criminal duty solicitor fee scheme.</p><p>In June 2019 the Government took the decision to accelerate certain key areas of the Criminal Legal Aid Review that were highlighted to be of immediate concern to defence practitioners.</p><p>In addition to monitoring duty solicitor coverage on an ongoing basis where issues are identified, the Government continues to take action to ensure there is ongoing availability of criminal legal advice for the public.</p><p> </p> more like this
