star this property answer text <p /> <p>Legal aid in England and Wales is available to victims of domestic violence where they need it to help break free from the abusive relationship. Access to legal aid for protective injunctions to prevent domestic violence remains identical to that prior to the legal aid reforms. These matters continue to be funded without the need for evidence. In private family law cases (such as child or financial arrangements) legal aid continues to be available where there is evidence of domestic violence or child abuse - the list of acceptable evidence is wide and comprehensive.</p><p> </p><p>In a recent judgment, the High Court found that the domestic violence evidential requirements are lawful and reflect the intention of Parliament in providing legal aid for those victims of domestic violence who require assistance because they will be intimidated or materially disadvantaged by having to face their abuser in court.</p> more like this

Legal aid also remains available in private family cases that involve domestic violence. We have listened closely to any concerns about how the system has been operating, and made changes in response, such as making it easier to prove abuse and so get legal aid.</p> more like this

star this property answer text <p>The Civil Legal Aid (Procedure) Regulations set out that once a legal aid certificate is granted, subsequent applications for either a new form of civil legal services or for new proceedings to be added to a certificate, and for which a new determination is being sought, will require further evidence to be provided.</p><p> </p><p>This Government is absolutely clear that victims of domestic violence should get legal aid where it is needed to help break free from the abusive relationship. Since the reforms were introduced last year thousands of people have successfully applied for legal aid where domestic violence is involved.</p><p> </p><p>The 24 month time limit for evidence does not exclude victims where the abuse occurred over two years ago. The time limit relates to the date the evidence was obtained, not the date of the abuse itself. Some forms of evidence can be obtained several months or even years after the abuse has been experienced.</p> more like this

This included confirmation that we plan to remove the time limit on evidence of domestic violence and to broaden the types of evidence that can be accepted.</p><p> </p><p>We are in the process of reviewing legal aid for domestic violence victims in private family law cases, and will announce the full extent of our proposals to Parliament in due course.</p> more like this

star this property answer text <p>We are aware that some GPs have been charging to provide letters as evidence of domestic abuse to support legal aid applications. Charges for services provided by GPs are set through the contractual relationship between GPs and the NHS.</p><p> </p><p>This practice is unacceptable. GPs are charging people at their most vulnerable and we are working with the Department of Health and Social Care to identify what more we could do to help victims of domestic abuse access the help they need. This important issue has been put forward as part of the GP contract negotiations for 2019-20. Whilst the content of those negotiations is not discussed publicly until an agreement has been reached, the Government is committed to dealing with this issue, through this process.</p> more like this
