	answer	answer is ministerial correction date of answer 18/07/2019 answer text <p>The Homes (Fitness for Human Habitation) Act 2018 is helping to drive up standards in the private and social rented sectors by putting an obligation on landlords to ensure that any rented residential properties are free of all hazards, including overcrowding, from which a risk of harm may arise to the health or safety of the tenant or another occupier of the property. This requirement applies from the outset and for the duration of the tenancy.</p><p>This Department has not made a specific assessment of the implications for properties that are smaller than 13 square metres in relation to the Homes Act. The courts will decide whether a property is fit for human habitation by considering the matters set out in section 10 of the Landlord and Tenant Act 1985, which includes the ‘overcrowding’ hazard prescribed in the Housing Health and Safety (England) Regulations 2005. We know more needs to be done to protect consumers.</p><p>We have announced our intention for a New Homes Ombudsman to be established and I am considering options for a shadow ombudsman. We will be bringing forward legislation to require developers to belong to a New Homes Ombudsman, which will treat home buyers fairly. We’ll soon be consulting on the details of how this will work - to raise standards and ensure that problems encountered by consumers are resolved faster and more effectively.</p><p>We will also establish the condition that housing developers must belong to a New Homes Ombudsman to participate in the new Help to Buy Scheme in England, post 2021. By the mid-2020s, we aim to have increased house building to an average of 300,000 net new homes a year. And as we move towards achieving this target, we will not sacrifice higher quality and standards.</p><p>We have already made commitments to provide better protection for purchasers of new build homes who experience snagging issues and we know more needs to be done. On 1 October 2018, we announced our intention for there to be a New Homes Ombudsman to protect the rights of homebuyers and hold developers to account. We also announced our intention to bring forward legislation to require all developers to belong to a New Homes Ombudsman.</p><p>On 24 January, following a wide-ranging consultation with consumers and industry, we set out our plans to strengthen consumer redress for the whole housing market. I want to help plug the gaps in available redress services so that more people can get their housing disputes resolved without going through the courts. We will introduce legislation so that, in the future, ground rents on newly established leases of houses and flats are set at a peppercorn. Costs incurred by landlords for overseeing and appointing a managing agent, or carrying out wider services, can be recovered through the service charge or a marginally higher sales price.</p><p><br>Prior to introducing any final legislation in Parliament, the Government will undertake a regulatory impact assessment. As part of this evidence-based procedure, we will assess the economic, social, and environmental effects of the policy.
