	answer	answer is ministerial correction date of answer 17/06/2014 answer text <p> </p><p>The UK led the call for the urgent imposition of EU sanctions, imposing an asset freeze on 22 individuals suspected of misappropriating funds from the Ukrainian state. <br><br>Those assets which are proven to be the proceeds of corruption through criminal investigations, and subsequently confiscated, will be returned to Ukraine.<br><br>We do not release information on the value of assets frozen under financial sanctions in the UK for reasons of confidentiality, and we do not hold information on the value of assets frozen overseas. <br><br>It is our policy to work closely with other governments to assist them to trace and repatriate stolen assets. All appropriate criminal justice and administrative routes to support the Ukrainians are being explored. The Director of the Serious Fraud Office has opened a criminal investigation into possible money laundering arising from suspicions of corruption in Ukraine. Robust powers are alreadyavailable under existing drugs legislation to disrupt the sale of new psychoactivesubstances, including over the internet. So far, the Government has banned over 350 new psychoactive substances under the Misuse of Drugs Act 1971. In addition so-called ‘legal highs’ are often found to contain substances already banned in the UK. We have published guidance for local authorities and Trading Standards on a range of legislative tools available to tackle the visible trade including in ‘head-shops’. This includes information on the Intoxicating Substances (Supply) Act 1985 which makes it an offence for a person to supply a substance that is not already controlled under the Misuse of Drugs Act 1971, to a person under the age of 18 if they know or have reasonable cause to believe that the substance is likely to be inhaled by that person, for the purpose of causing intoxication. Last year two ‘legal-high’ sellers were successfully prosecuted using this legislation. The Minister for Crime Prevention is currently leading an expert review to look at how the UK’s response to new psychoactive substances can be enhanced to ensure that law enforcement agencies have the best available powers and send out clearest possible message that the trade in these substances is reckless. 	answer	answer is ministerial correction date of answer 04/08/2014 answer text <p>It is not a requirement of the European Arrest Warrant Framework Decision that a State provide prima facie evidence when issuing a warrant. Prima facie evidence was similarly not required under the previous extradition arrangements for countries within the EU - the European Convention on Extradition of 1957.The Government has legislated to reform the operation of the EAW and increase the protections for British citizens and others who are wanted for extradition. These safeguards, contained in the Anti-Social Behaviour, Crime and Policing Act 2014, were commenced on 21 July 2014. These changes include the introduction of a proportionality bar. This requires a British judge to consider whether extradition would be disproportionate (and to discharge the person if it would be), taking into account the seriousness of the alleged conduct, the likely sentence the person would receive if convicted, and the possibility of the issuing State taking measures that would be less coercive than extradition. We have also addressed the concerns that relate to pre-trial detention. Where there are reasonable grounds for believing that decisions to charge and try the person have not been made, the issuing State must now prove that they have been (unless the only reason for this is the person's absence from the issuing State), or the judge is required to discharge the person. This will help ensure people are not extradited only to spend length periods in pre-trial detention whilst the issuing State continues to investigate the offence. In addition, to help deal with concerns relating to length pre-trial detention, it is now possible for an individual to be temporarily transferred to the issuing State or to speak with the authorities in that State by videoconference ahead of the extradition hearing the UK, if the person consents. We have also made the Extradition Act 2003 clearer with regard to the existing requirement for dual criminality; in particular, setting out that in cases where all or part of the conduct occurred in the UK, and the conduct is not criminalised here, the European Arrest Warrant must be refused for that conduct. The Government has also introduced (by way of the Crime and Courts Act 2013) a forum bar, to ensure that the possibility of a domestic prosecution has been properly explored as part of the extradition proceedings. There are strict statutory safeguards in place regarding access to data stored on mobile phones. There are a number of pieces of legislation which allow for search and seizure of items including mobile telephones, for example, the Police and Criminal Evidence Act 1984 (PACE), the Terrorism Act 2000, the Extradition Act 2003. These laws only allow data to be searched if the phone has been lawfully seized under a power in the legislation. Property interference by the Security and Intelligence Agencies may be authorised under the Intelligence Services Act 1994 or the Security Service Act 1989. Property interference by the police may be authorised by the Police Act 1997.
