	answer	answer is ministerial correction date of answer 29/01/2020 answer text <p>The law responds to hate crime in four ways by:</p><ul><li>providing for additional “aggravated” offences with longer sentences in the Crime and Disorder Act 1998 if an offender demonstrated hostility or was motivated by hostility based on race or religion.</li><li>prohibiting conduct that is likely to stir up hatred on grounds of race, or intended to do so on grounds of religion or sexual orientation in the Public Order Act 1986.</li><li>providing for enhanced sentencing under sections 145 and 146 of the Criminal Justice Act 2003 if hostility is motivated by any of the five protected characteristics: disability, transgender status, race, religion or sexual orientation; and</li><li>providing Sentencing guidelines. Section 125(1) of the Coroners and Justice Act 2009 requires that a sentencing judge must follow any sentencing guideline which is relevant to their case. This includes, for example, consideration of whether the offence was motivated by racial or religious hostility, or if it was motivated by or demonstrated hostility towards the victim based on one or more of several of the victim’s characteristics: age, sex, gender identity (or presumed gender identity), disability (or presumed disability) or sexual orientation.</li></ul><p>The Government have invited the Law Commission to review the law relating to hate crime and to make recommendations to the Government for its reform. The review began in March 2019.</p><p> </p><p>Specifically, the Law Commission have been asked to consider the current range of offences and aggravating factors in sentencing, and to make recommendations on the most appropriate models to ensure that the criminal law provides consistent and effective protection from conduct motivated by hatred towards protected groups or characteristics. The review will also take account of the existing range of protected characteristics, identifying any gaps in the scope of protection currently offered under the law and making recommendations to promote a consistent approach.</p><p> </p><p>The Law Commission plan to issue a consultation on this matter in early 2020. 	answer	answer is ministerial correction date of answer 28/04/2014 answer text <p> </p><p> </p><p>The National Offender Management Service (NOMS) does not hold records of employees found guilty of all types of criminal activity.</p><p> </p><p>Whilst the vast majority of its staff are honest and hard working, NOMS is committed to detecting, deterring and disrupting all corrupt behaviour by individuals working in prisons. A dedicated NOMS Corruption Prevention Unit was set up to ensure staff corruption is identified and tackled. As part of this work NOMS has compiled a central record of staff convicted of criminal offences which meet the NOMS definition of corruption.</p><p> </p><p>This definition is that corruption occurs when a person in a position of authority or trust abuses their position for their or another person's benefit or gain. This would include the misuse of their role in order to plan or commit a criminal act, or a deliberate failure to act to prevent criminal behaviour.</p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p>There were <strong>23</strong> convictions for corruption-related offences during 2013. The courts also have the power to disqualify the offender from driving and must in any event endorse the offender's licence by between three and six penalty points. Alternatively, if the police decide that the nature of the offence was less serious, they may offer the motorist the opportunity to receive a fixed penalty notice instead of prosecution. The case management database for magistrates' courts does not hold the date of conviction in a way we can calculate the time from conviction to sentence for all defendants so the only way we could answer the question would be to manually check each case file which would incur disproportionate costs.</p><p>The Crown Court database does and Table 1 below shows the average length between the latest conviction date in a trial and the date of sentence. The trend has seen the time between conviction and sentence falling from an average of 35.8 calendar days in 2007-08 to 24.6 calendar days in the first half of 2013-14. We have a voluntary PTA with India and are planning to work to try and make this more effective.</p><p> </p><p>The Prisoner Transfer process is just one mechanism for removing Foreign National Offenders (FNOs). The number of FNOs deported under the Early Removal Scheme (ERS) has increased under this Government. Prisoners are also able to raise concerns through other channels such as the IMB, their MP or the Prison and Probation Ombudsman. Any member of staff who has such concerns can submit an intelligence report or speak to a colleague, manager, their security department or specialist staff.</p><p> </p><p>Prison staff are required to report on a wide range of behaviours linked to extremist motivated activities some of which could represent radicalisation. Such reports are considered by a prison-based multi agency panel to help access the motivation for the reported behaviour and to direct further action to develop the information or to intervene with the prisoner. Prisoners are also able to raise concerns through other channels such as the IMB, their MP or the Prison and Probation Ombudsman. Any member of staff who has such concerns can submit an intelligence report or speak to a colleague, manager, their security department or specialist staff.</p><p> </p><p>Prison staff are required to report on a wide range of behaviours linked to extremist motivated activities some of which could represent radicalisation. Such reports are considered by a prison-based multi agency panel to help access the motivation for the reported behaviour and to direct further action to develop the information or to intervene with the prisoner. 	answer	answer is ministerial correction date of answer 07/04/2014 answer text <p> </p><p> </p><p>HM Prison The Verne started taking immigration detainees as scheduled from 24 March 2014. The National Offender Management Service (NOMS) will retain The Verne as a prison in the short term. Its designation as a prison will be reviewed later this year, with the intention of completing the re-designation to an immigration removal centre by the end of September 2014.</p><p> </p><p>While The Verne retains its designation as a prison it will be governed by Prison Rules rather than Detention Centre Rules. As The Verne is not governed by Detention Centre Rules, Rule 35 of those rules is not applicable.</p><p> </p><p>Detainees held at The Verne will be treated in the same way as other detainees held within the prison estate. As such they will not have access to mobile telephones or the internet, nor will they be able to receive telephone calls. They will, however, be able to make telephone calls and will have access to both social and legal visits.</p><p> </p><p>There is a dedicated Home Office Immigration Enforcement Team on site who will see detainees routinely on induction and upon request. In mid December 2013, the bidders who passed the first stage of the competition to win the regional rehabilitation contracts were announced. The list includes a mix of private and voluntary sector partnerships with more than 50 organisations represented – from charities experienced in tackling a range of issues affecting offenders, to small and large British businesses and experienced multinationals. All of these Tier one bidders have experience in working with offenders or across the wider Criminal Justice System. Approximately one third of the bidders included a potential mutual organisation within their consortium. Additionally, for similar commercial reasons it is not general practice to release information on those organisations which have withdrawn from the competition.</p><p> </p><p>As requested by the Authority, all bidders updated their CPA preferences on 22<sup>nd</sup> January. The current lot preferences are an initial indication of the bidders for each region. 	answer	answer is ministerial correction date of answer 03/04/2014 answer text <p>The offences of using a TV receiver without a valid licence and of failure to hold a valid vehicle excise duty licence (tax disc) are not punishable by imprisonment, so offenders cannot be sentenced to custody for these offences. Failing to pay council tax is not a criminal offence.</p><p> </p><p>Offenders found guilty of TV licence or vehicle excise evasion may be sentenced to a fine. Failure to pay a fine can lead, following enforcement action and as a last resort, to committal to prison for fine default. Failure to pay council tax is pursued through the civil courts and can also lead, ultimately, to committal to prison.</p><p> </p><p>Data for receptions into prison for defaulting on the TV licence fine, in England and Wales, 2008 to 2012 can be viewed in table 1 below.
