star this property answer text <p>Proscription is an important means of disrupting terrorist organisations in the UK. The Islamic State of Iraq and the Levant (ISIL) also known as The Islamic State of Iraq al-Sham (ISIS) was proscribed as a terrorist organization in the UK with effect from 20 June 2014.</p><p> </p><p> </p><p> </p><p>Section 13 of the Terrorism Act 2000 provides that a person commits an offence if he, in a public place, wears an item of clothing or wears, carries or displays article in such a way or in such circumstances as to arouse reasonable suspicion that he is a member or supporter of a proscribed organisation. Flags would come within the definition of “article”. This is a summary only offence carrying a maximum of six months imprisonment or a fine.</p><p> </p><p> </p><p> </p><p>To date there have been no prosecutions in England and Wales as a result of displaying a flag in such a way or in such circumstances as to arouse reasonable suspicion that the person displaying it is a member or supporter of ISIL. A black flag of the type associated with ISIL has featured in a number of prosecutions of individuals for more serious terrorist offences.</p><p> </p>

They may, however, be of relevance to criminal offences which can be prosecuted.</p><p>The Crown Prosecution Service (CPS) does not maintain a central record of prosecutions where Munchausen’s syndrome by proxy or fabricated or induced illnesses may have been relevant. Such information could only be obtained through a manual search of records which would incur disproportionate cost.</p> more like this

star this property answer text <p>Ensuring that staff have the tools and skills necessary to prosecute effectively is a CPS priority. A detailed CPS/Police Joint National Rape Action Plan was published in June 2014 which identified a programme of training activity to deliver improvements in investigation and prosecution outcomes. This extensive programme, consisting of a range of face to face specialist training, is currently underway. The programme includes refresher training for all specialist prosecutors undertaking rape and serious sexual offence casework which will be delivered during 2016.</p> more like this

There is a related offence under section 97 of that Act of intentionally obstructing a person carrying out an inspection where it is believed that an offence under section 96 is being committed.</p><p> </p><p>The Crown Prosecution Service has not prosecuted any cases involving either of these offences.</p><p> </p><p> </p> more like this

star this property answer text <p>The offences under sections 96 and 97 of the Education and Skills Act 2008 came into force, as they relate to independent schools, on 5 January 2015. Since that date two cases have been referred to the Crown Prosecution Service for early investigative advice following which investigations were discontinued. Two further cases have been referred to the Crown Prosecution Service for a charging decision. In both of these latter cases the evidential test under the Code for Crown Prosecutors was not met.</p><p> </p> more like this

star this property answer text <p>In order for an offence to constitute a “hate crime”, first a “basic” crime has to be committed. There are a number of such possible offences which can be committed by way of an insult, particularly offences under the Public Order Act 1986, the Malicious Communications Act 1988 and the Communications Act 2003.</p><p>Such offences could be designated as a “hate crime”, if they meet the required criteria for the three strands of hate crime offences – (a) racially and religiously aggravated offences; (b) homophobic, transphobic and biphobic offences and (c) disability hate crime.</p><p>The Government does not issue legal guidance to the Crown Prosecution Service (CPS), which is independent. The CPS hate crime guidance, which must be followed by all prosecutors, was reviewed and published in June 2017.</p><p> </p> more like this
