star this property answer text <p>Chapter 4 of Part 1 of the Consumer Rights Bill applies to contracts between a trader and a consumer, for the trader to supply a service to a consumer. A residential lease itself is not considered a service, as it is an “interest in land”, and, as such, chapter 4 of the Consumer Rights Bill does not apply. Chapter 2 of Part 1 of the Consumer Rights Bill applies to contracts between a trader and a consumer, for the trader to supply goods to a consumer. Goods are defined as “tangible moveable items”, so do not include land which is immoveable property.</p><p> </p><p> </p><p> </p><p>Rights and protections specific to long residential leases are provided through landlord and tenant legislation, including the Landlord and Tenant Act 1985, Landlord and Tenant Act 1987, and the Commonhold and Leasehold Reform Act 2002.</p><p> </p><p> </p><p> </p><p>Leases are also contractual arrangements between a landlord and tenant or leaseholder which defines each party’s interests, rights and obligations in respect of the leasehold and, as such, Part 2 of the Consumer Rights Bill on Unfair Terms would apply where the landlord is a “trader” and the leaseholder a “consumer”.</p><p> </p><p> </p><p> </p><p>Part 1 and Part 2 of the Consumer Rights Bill will apply to contracts between a trader and a consumer entered into after the Bill comes into force.</p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p>

Consumers or their representatives should report any alleged breach through the Citizens Advice consumer helpline who will report substantive breaches to Trading Standards, or to the police, to take enforcement action as appropriate.</p><p>The Government has launched an Independent Review of consumer protection measures in relation to ticket resale and online Secondary Ticketing facilities under Professor Waterson, and Contributions and evidence from interested parties are welcome. This review will gather evidence on how well the Consumer Rights Act’s new ticketing provisions and wider consumer protections are working.</p><br /> <br /> more like this

star this property answer text <p>Advice on second hand car purchases features regularly in consumer awareness campaigns led by Trading Standards and the Citizen’s Advice Service. Consumers should call the Citizen’s Advice consumer helpline, which receives its funding from Government, for advice on fraud and to report alleged offences of misleading advertising or mis-selling.</p><br /><p>The Citizen's Advice Service will refer clear breaches of consumer law to Trading Standards and advise on reporting suspected fraud to ‘Action Fraud’, the national fraud database led by The City of London Police. ‘Action Fraud’ has received 67 complaints of mileage fraud since 2010 and actively campaigns for more fraud cases to be reported, with viable lines of enquiry, to equip the police to convict the culprits.</p><br /> more like this

star this property answer text <p>The Government advises consumers through Gov.uk to contact the Citizens Advice consumer helpline, which is funded by BIS, on any questions relating to consumer law, including ticket resales. The helpline advises consumers on their rights and remedies and will pass on complaints to Trading Standards where appropriate.</p><br /><p>Awareness of the helpline is also raised through national consumer campaigns such as Scams Awareness Month and National Consumer Week which Government supports through the Consumer Protection Partnership.
