star this property answer text <p>Any foreign national who is convicted of a crime and given a prison sentence is considered for deportation at the earliest opportunity. Where appropriate, the Government will also seek to permanently remove foreign criminals from the UK via the Early Removal Scheme once they have served the minimum required of their sentence. This is our best performing removal scheme with 5,262 Foreign National Offenders (FNOs) having been removed between January 2019 and June 2022.</p><p>The Home Office removed 16,676 foreign national offenders since January 2019 to September 2023. Published figures show that FNO returns have increased in the latest 12-month period (ending September 2023) by 19% when compared to previous 12-month period.</p><p>Our new Prisoner Transfer Agreement with Albania entered into force in May 2023 and we have signed a new Prisoner Transfer Agreement with the Philippines. star this property answer text <p>Young people who begin their sentences in the youth custodial estate, because they are under 18 at the time of sentencing, do not automatically transfer to the adult estate on reaching their eighteenth birthday. As of June 2023, 148 young people aged 18 <del class="ministerial">and over</del> were being accommodated in young offender institutions.</p><p>Custody should always be a last resort for children. We have made great strides to reduce the numbers of children in the youth justice system. The most recent publication of Youth Justice Statistics showed the 20/21 population fell by 19% compared to the previous year and was 77% lower than the population for the year ending March 2012.</p> more like this

star this property answer text <p>The Ministry of Justice publishes information from 2010 to 2022 on the number of defendants <del class="ministerial">prosecuted </del><ins class="ministerial">prosecuted, convicted and sentenced</ins> for offences under Section 18 of Offences Against the Person Act 1861 (offence code 00501), in the ‘Outcomes by Offence’ data tool.</p><p>The attached tables provide a breakdown of <ins class="ministerial">average custodial sentence length (ACSL) for defendants sentenced</ins> <del class="ministerial">convictions</del> for the offence contrary to Section 18 of the Offences Against Person Act 1861 (causing grievous bodily harm with intent) within the last three years, where it has been treated as a principal offence by Crown Court (table 1), and in all courts by information on gender (table 2), ethnicity (table 3), and age (table 4).</p><p>Detailed offence data at Crown Court are only available in the Court Proceedings Database from 2020 onwards. Therefore, figures for all tables have been limited to 2020 onwards in order to give a complete view of each year presented.</p>

star this property answer text <p><ins class="ministerial">There were 53,253 probate cases in the Open Caseload<sup>1</sup> as at 31 December. Of those 30,656 were more than 6 weeks old<sup>1</sup>. Of the cases over six weeks old 13,536 were stopped, 7,247 were awaiting documentation and 9,873 were ready to progress.</ins></p><p><ins class="ministerial"><sup>1 </sup>Data as at 31 December in line the official published stats. The administration of probate applications is dealt with as a national service, covering England and Wales. The open caseload excludes cases older than 6 months.</ins></p><p><ins class="ministerial"><sup>2</sup>The time outstanding is counted from the application submission date recorded in the case management system, except for digital applications with a Will, where the date of receipt of the original Will by HMCTS is used.</ins></p><p><ins class="ministerial">This data is management Information. The management information presented in this table reflects what is recorded on relevant case-management systems on the date of extraction. The case management systems are continually updated and so the information presented will differ from previously published information. Management information can differ from the quality assured MOJ official statistics, which form the agreed definitive position. Although care is taken when processing and analysing the data, the details are subject to inaccuracies inherent in any large-scale case management system and is the best data that is available.</ins></p><p><del class="ministerial">The total amount of unassessed probate cases where evidence has been received to enable a case to be assessed is 12,923.</del></p><p><del class="ministerial">4805 of these cases are over 6 weeks since the date the evidence was received.</del></p><p><del class="ministerial">In addition, there are 38,245 cases which are either waiting for evidence, such as the original will, to arrive, are subject to a legal hold following an application from another party or have been stopped due to an error or missing documentation and are waiting for a response from the applicant.</del></p><p>HMCTS has increased resources to meet the higher demand following an increased number of estates requiring probate and is further increasing resourcing to further bring down overall timeliness on digital and paper applications.</p><p>The improvement of the online probate system remains a priority for HMCTS, to ensure more applications can be issued first time and resources can be focused on reducing waiting times.</p>

star this property answer text <p>I can confirm that we received the Area Coroner’s Report to Prevent Future Deaths and the findings of fact on 29 June 2022. The Victims Minister <del class="ministerial">has now written</del> <ins class="ministerial">replied on 1 December</ins> to apologise for the delay in acknowledging receipt and thanking her for the comprehensive report into this terrible and tragic case.</p><p>We are aware that the Home Office responded to the Coroner within the 56-day timescale and we are supportive of the work that they have referenced in the cross Tackling Domestic Abuse Plan (published in March 2022) that is looking to address a number of these issues including:</p><ul><li>developing the evidence base and interventions to prevent suicides linked to domestic abuse, as well as support a package of measures to tackle suicides which take place following domestic abuse;</li><li>updating police guidance on suicide so that it explicitly includes references to domestic abuse and for the police to consider whether domestic abuse was a contributing factor in cases of unexplained deaths and suspected suicides; and</li><li>promoting the Domestic Abuse Act 2021 Statutory Guidance (published in August 2022) which sets out what best practice in supporting victims looks like, including for multi-agency working and Multi Agency Risk Assessment Conferences.</li></ul>

star this property answer text <table><tbody><tr><td colspan="2"><p><del class="ministerial">Chartered flights by spend - MOJ</del></p></td></tr><tr><td><p><del class="ministerial">2020 – 2021</del></p></td><td><p><del class="ministerial">£563,624.12</del></p></td></tr><tr><td><p><del class="ministerial">2021 – 2022</del></p></td><td><p><del class="ministerial">£546,791.33</del></p></td></tr><tr><td><p><del class="ministerial">2022 – YTD (Sept)</del></p></td><td><p><del class="ministerial">£543,907.12</del></p></td></tr></tbody></table><p><del class="ministerial">The MOJ holds data for the last three years 2020, 2021 and 2022, however due to the system limitations and internal policies we are unable to break down the amount spent on Ministerial travel as Ministers are not considered employees of the department. They are therefore not required to create accounts and book their own travel which can be monitored through our management reports. Instead, their travel is booked by Private Office employees and logged as guest users.</del></p><p><del class="ministerial">Furthermore, any flights for prisoners would not show on the MI that they are for a prisoner. We are therefore unable to break down prisoner travel for the same reason as Ministers due to not being employees of the department and not requiring accounts.</del></p><p><ins class="ministerial">The answer given to the question on 4 November 2022 provided the spend on commercial flights by the MOJ, rather than the cost specifically of private charter flights.</ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">The MOJ does not monitor spend on private charter flights, because a very low volume of private charter flights are used. To provide an answer to the cost of private charter flights since 2010 would incur a disproportionate cost. Information for charter flights used by ministers during 2022 has been provided below. Private charter flights are occasionally used for prisoner repatriations and for travel by ministers and senior civil servants when suitable commercial flights are not available.</ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">In respect of the use of charter flights for ministers, during 2022, one private charter flight was used by the Deputy Prime Minister and nine officials for return travel to the Hague at a cost of £22,895. This was disclosed in transparency data at the time.</ins></p>
