star this property answer text <p>Local Youth Offending Teams (YOTs) are multi-agency partnerships (which include health services) and they determine which services are needed to address the needs of the children who offend in their area. As of June 2017, there were 127 full time equivalent posts for seconded mental health practitioners working in YOTs in England and Wales. This included 59.7 part time and 68 full time posts.</p><p> </p><p>Additionally, Clinical Commissioning Groups (CCGs) in England, are expected to work with NHS England and local partners across the NHS, public health, children and adult social care, youth justice and the education sectors, to jointly develop and take forward local plans to improve children and young people’s mental health and wellbeing, including children going through the youth justice system. In Wales, Local Health Boards (LHBs) are responsible for planning and delivering medical services, and aim to integrate specialist, secondary, community and primary care and health improvements. Even where there is no child psychologist or mental health professional embedded within the youth offending team, areas should have provision for children to access appropriate mental health support.</p>

Although local level Youth Offending Services have the ability to collect data on children’s nationality using their case management systems, it is unknown how many actually do record this information because the Youth Justice Board do not collate data on nationality centrally. star this property answer text <p>Efforts to better understand and tackle racial disparity in the Criminal Justice system are typically resourced as part of the mainstream responsibilities for Ministry of Justice and partner organisations, without dedicated budget(s). As such we have not been able to isolate the spend requested. Some additional commentary follows.</p><p> </p><p>On a) per Government’s response to David Lammy’s review of the treatment of BAME people in the CJS, we remain committed to publishing more and better data to inform us on issues of racial disparity in the criminal justice system.</p><p> </p><p>On b) Ministry of Justice is funding a three year programme, the Pre-Application Judicial Education programme, to support improving judicial diversity at a cost of £300,000 over financial years 2018/19 to 2020/21. The Judicial Appointments Commission also lead on initiatives to support diversity in the judiciary including outreach events.</p><p> </p><p>On c) as a matter of course our work on tackling racial disparities engages with academics and their research.</p><p> </p><p>On d) we have taken a range of steps to integrate activity to reduce racial disparities within the youth custodial estate in to the work of establishments and to drive improvements. This includes having dedicated equalities staff in Youth Offender Institutions and Secure Training Centres. We also have specific members of staff based at head-quarters, both within the Ministry of Justice and the Youth Custody Service, who consider the needs of BAME children, develop and implement improvement initiatives and feed into wider policy and delivery work. Examples include, the appointment of a Senior Policy Advisor: BAME Development lead to help address Recommendations 28 and 29 of the Lammy Review, on the recruitment of BAME staff; the YCS mandating the take-up of unconscious bias training for senior managers across public sector establishments, the commissioning and introduction of ‘debiasing training’ for key staff; and the inclusion of a problem-solving approach to complaints (Lammy Review Recommendation 27) in the new Youth Custody Service framework for behaviour support.</p>

star this property answer text <p>The guidance already applies to secure children's homes.</p><p> </p><p>The safety and welfare of children held in youth custody, including secure training centres (STCs), is our highest priority and we take any incident in which a child is restrained very seriously. In STCs, restraint is only ever to be used in accordance with the Secure Training Centre Rules 1998 and as a last resort where there is a risk of harm and no other form of intervention is possible or appropriate.</p><p> </p><p>The guidance for STCs, Minimising and Managing Physical Restraint, has been specifically developed to help staff avoid physical restraint as far as possible by using a range of de-escalation, diversion and behaviour management techniques.</p> more like this

star this property answer text <p>We have long worked collaboratively with the Department for Education (DfE) to improve educational and other rehabilitative outcomes for children in the youth justice system.</p><p>The DfE has a proactive role in the governance and delivery of many youth justice projects:</p><ul><li>Our new secure schools model for youth custody has been developed collaboratively with the DfE and has a strong focus on improving the provision of education through the commissioning of child-focused providers.</li><li>We are retendering learning services in young offender institutions (YOIs) by September 2021 when existing contracts are due to expire. The DfE is part of this project and provides advice on it, particularly regarding developing service requirements and engaging schools, colleges and academy trusts.</li><li>The DfE and Ministry of Justice (MoJ) work closely with other government departments to implement the cross-government serious violence strategy, which includes provisions for schools-based early intervention and prevention initiatives where appropriate, and to minimise the harmful impact of school exclusions.</li></ul><p>Over the longer-term, the DfE, MoJ and other government departments are reviewing the structure and governance of the youth justice system in Wales and the entire youth secure estate to improve alignment, standards and outcomes for children</p>

star this property answer text <p>Youth Offending Services (YOS) were established in the Crime and Disorder Act 1998, which introduced a statutory duty for all local authorities to establish a multi-agency team, with members from police, social services, probation and education, to deliver youth justice services. YOS have a statutory duty to:</p><ul><ul><li>provide appropriate adults for children detained or being interviewed at the police station and provide support for children on bail;</li><li>help young people and their families through court proceedings;</li><li>write pre-sentence reports for the courts advising on appropriate interventions;</li><li>supervise young people serving a community sentence;</li><li>stay in touch with a young person if they’re sentenced to custody; and</li><li>assist in the child’s resettlement post-custody.</li></ul></ul><p>All children who come into contact with the YOS (including EEA nationals) will have their individual circumstances and needs assessed and will receive interventions and support accordingly.</p>

star this property answer text <p>We believe that that children who offend should have the opportunity to learn from their mistakes and move ahead positively with their lives while ensuring ensure the public are adequately protected.</p><p>The criminal records disclosure regime is designed to help employers make informed recruitment decisions through the disclosure of appropriate and relevant information, particularly for roles involving children and vulnerable adults.</p><p>We have noted the Supreme Court judgment in P and others and my department is working closely with the Home Office to reform the existing regime.</p> more like this

star this property answer text <p>The Youth Custody Service has commenced reform of education services and are developing a vision for learning. Included in the education reform is the provision of wellbeing and exercise with flexibility of provisions. The vision for learning is expected to bring about flexibility which is tailored to the needs of children within the secure estate and we are working with our education</p><p>providers to increase the flexibility of the core day and curriculum to allow for more space, time and resources to provide young people with the activities that are tailored to their needs and offer the most positive engagement with education.</p><p> </p><p>We have also devolved additional funds to Young Offender Institutions (YOIs) governors to commission additional educational, vocational and enrichment activities that best engage and meet the needs of the children in their establishments. This amounts to £0.3m in 18/19 and £1.8m in 19/20 across the four public sector sites.</p><p> </p><p>Where available the information requested on the allocations to the requested establishments for prison libraries are provided in the attached table. Prior to 2014 all library finances were carried out locally in establishments, and are therefore not included. Data for establishments which were or are Privately Managed Prisons are not available as the cost of provision is included in the overall budget. It should also be noted that at HMYOI Feltham the library is shared across both sites and the figures provided are for full provision. Budgets for 19/20 have yet to be officially allocated.</p>

In order to obtain it, we would need to collate reports of individual referrals made by all establishments holding young people under 18, over a period of ten years.</p><p> </p><p>The Youth Custody Service takes the safety and well-being of young people in custody very seriously. It has conducted an internal review of safeguarding across the youth secure estate, and a new ‘Head of Safeguarding’ post has also been created to lead on taking forward this important area of work.</p> more like this
