star this property answer text <p>The draft regulations published for consultation in November proposed that the power of intervention may be exercised in cases where, on the basis of evidence and after consultation with relevant bodies, we believe that an administering authority is failing to act in accordance with any guidance issued under the draft regulations. For example, the power could be used where an administering authority did not follow the guidance and criteria on pooling of assets, also published in November.</p><p>No final decision has been taken on the draft regulations. The Govenrment's response to the consultation will be published shortly.</p> more like this

star this property answer text <p>We have received a large number of recent representations about the power of intervention in the investment regulations currently before the House. Under the new regulations, administering authorities are significantly more responsible and accountable for their investment decisions. They will no longer be constrained by central prescription on how their assets are invested, provided they act reasonably within the framework provided by the regulations and guidance.</p><p>The power of intervention has been included in the regulations as a backstop in order to protect around £200 billion of funds in the local government pension scheme, in the rare circumstances where it might be necessary to do so. As set out in the Government response to consultation the regulations include a number of safeguards, including full consultation with the relevant authority, to ensure that the power is used appropriately and proportionately. We have made clear that the intervention power will be used sparingly and only where fully justified.</p>

Since 2000, pension fund authorities have been required to publish a statement of investment principles, including their policy on the extent to which social, environmental or ethical considerations are to be taken into account in the selection, retention and realisation of investments. The regulations also require that each statement is published locally.</p><p>We have no immediate plans to change these existing obligations, but will keep them under review.</p> more like this
