The “Cyber Crime: Cyber Stalking” course includes cyber stalking, non-cyber stalking and harassment. The “Stalking and Harassment” course (which was released in April 2014) deals specifically with stalking and harassment offences.

The CPS maintains a central record of the number of employees who have been trained on the law on stalking by way of the e-Learning courses. 1581 of its employees in post on 23 October 2014 have completed all elements of either of the e-Learning courses in the period between 1 November 2012 (the month when the Cyber Stalking e-Learning module was revised to include the new stalking offences) and 23 October 2014.

In October 2014 the CPS issued follow-up, face-to-face training material on the Stalking and Harassment offences. It can be used flexibly at a local CPS level; accordingly, its delivery is not recorded on a central database.

Although there are no current plans for new training products to be launched, the CPS will continue to train its staff in this critical area of work.

In both cases the CPS concluded that there was no realistic prospect of conviction for the charge selected by the private prosecutor.

In addition the CPS considered whether both sets evidence taken together might be sufficient to provide a realistic prospect of conviction for any abortion offence. It was concluded that there was sufficient evidence to prosecute an offence of using poison, instruments or any other means with intent to procure an abortion but that this was very finely balanced. It further concluded that the public interest considerations in not pursuing a prosecution outweighed those in favour for the same reasons as in 2013, most importantly the lack of professional guidance on how doctors should approach comparative risk assessments.

The full reasons for the decision are available on the Crown Prosecution Service (CPS) website: http://www.cps.gov.uk/news/latest_news/cps_decision_to_stop_private_prosecutions_of_doctors_charged_with_abortion_offences/

Such information could only be obtained through a manual search of records which would incur disproportionate cost.

The CPS is however committed to reducing unnecessary delays in the magistrates’ court, together with other CJS partners, through the Transforming Summary Justice initiative (TSJ). One of the principles of TSJ is to implement a more effective disclosure process to ensure the streamlining of disclosure to defence practitioners for first hearings.

The Better Case Management process (BCM) and the CPS Crown Court Strategy, which interlink with TSJ, also ensure that in cases destined for the Crown Court there is greater focus on Crown Court file build at the very outset to provide sufficient evidential material for the first hearing.
more like this
