star this property answer text <p>The Mental Capacity Assessment requires a two-stage test of capacity.</p><p><strong>Stage 1</strong>. Is there an impairment of, or disturbance in the functioning of a person's mind or brain? This could be due to long-term conditions such as mental illness, dementia, or more temporary states such as confusion, unconsciousness, or the effects of drugs or alcohol and</p><p><strong>Stage 2</strong>. Is the impairment or disturbance sufficient that the person lacks the capacity to make a particular decision?</p><p>The Mental Capacity Act says that a person is unable to make their own decision if they cannot do one or more of the following four things:</p><ul><li>Understand information given to them;</li><li>Retain that information long enough to be able to make the decision;</li><li>Weigh up the information available to make the decision;</li><li>Communicate their decision – this could be by talking, using sign language or even simple muscle movements such as blinking an eye or squeezing a hand.</li></ul><p> </p>

star this property answer text <p>The Government is committed to ensuring that all victims of crime, including crime that constitutes anti-social behaviour, receive the help and support they need.</p><p> </p><p>The Criminal Injuries Compensation Scheme (the Scheme) is a government-funded scheme that exists to compensate blameless victims of violent crime who have sustained physical or mental injuries. The rules of the Scheme and the tariff of awards to be paid are approved by Parliament, and the Criminal Injuries Compensation Authority (CICA) administers these rules independently of Government.</p><p> </p><p>Victims of anti-social behaviour who suffer physical or mental injury as a result of a crime of violence as set out in Annex B of the Scheme may be entitled to claim compensation from the CICA.</p> more like this

star this property answer text <table><tbody><tr><td><p>The current Prison Estate Transformation Programme prison projects are based on a new Category C prison design that is focussed on rehabilitation. The HMP Berwyn project, which included a lessons learned process throughout all stages of delivery, has provided the team with a template on which to build the new category C prison design. Lessons learned were recorded independently by the Operations team and the Design and Construction (Client and Contractor partnership) team with joint workshops held at key milestones. Academic input was also involved. The Design and Construction team used an iterative process to record findings throughout the project lifecycle. The lesson learned log identifies learnings against key topics, as follows:<ol><li>Design approach - provision and location of staff facilities; agile/flexible use of space; storage space; resilience of building types; digital technology.</li><li>Stakeholder input - identifying key challenges from specific third party service providers; achieving a consistent approach to stakeholder requirements; establishing the need for early stakeholder input to the design.</li><li>Detailed design and technical standards - wall finishes; roof pitch and overhang; use of window grilles; cell ventilation; manhole designs; electrical installation; pre cast concrete and standardised construction.</li></ol>The detail from each of the above has been fed into the planning and development of the design process for the new prisons.</p></td></tr></tbody></table>

The development of former burial grounds, whether or not they are consecrated, is subject to planning regulations and to any conditions placed on the granting of individual planning permissions. Relevant health and safety and environmental legislation would also apply. Monitoring compliance with these requirements is a matter for the relevant local authority in the first instance.</p><p> </p><p>The disturbance of human remains in ground consecrated to the rites of the Church of England must be authorised by the Church of England. For unconsecrated ground, authorisation is required from the Secretary of State for Justice. The unauthorised disturbance of human remains is a criminal offence and, therefore, a matter for the police.</p> more like this
