Where the age of a person is uncertain and there are reasons to believe that the person is a child, that person is presumed to be a child in order to receive immediate access to assistance, support and protection. Local authorities may only conduct an age assessment where there is significant reason to doubt that the claimant is a child. However, if a parent knowingly and deliberately takes their child on holiday during term time (without a leave of absence granted by the school) they could face a term of imprisonment for doing so if they are prosecuted under the substantive offence set out in section 444(1A) of the Education Act 1996 (the Act). 	answer	answer is ministerial correction date of answer 07/04/2014 answer text <p>261 schools were successful in their application to the Priority School Building Programme (PSBP) and initial work has started with over 230 of these schools. Construction work has started at 24 schools and the first primary school is due to open in May 2014.</p><p>The PSBP is aimed at addressing the condition needs of those schools most in need of urgent repair; it is not a programme aimed at increasing school capacity. However, where a school is seeking to expand and this is supported by pupil planning statistics, we are increasing the capacity of the schools.</p><p>The PSBP will create approximately 9,300 new primary school places through the expansion of these schools beyond the existing capacity stated in their application forms.</p><p>This number is subject to change. As part of the feasibility study undertaken for each school, we work with the school, local authority and other stakeholders to review pupil planning statistics for the area and confirm that the size of the school being rebuilt or refurbished is sustainable and also meets any demand for pupil places where possible.</p><p>We are on track to complete all PSPB schools by the end of 2017. These include identifying children not receiving a suitable education as defined in section 7 of the Education Act 1996. The guidance makes clear that although local authorities have power to require parents to provide information about the education which home educated children are receiving, this is a process best conducted informally and should not amount to routine monitoring. We have taken a range of actions to drive up the quality of education for those children who are educated in alternative provision (AP) following an exclusion, including through the introduction of AP academies and AP free schools.</p><p> </p><p>Information on the number of permanent and fixed period exclusions since 2000 is published in the “Permanent and fixed period exclusions from schools in England: 2011 to 2012 academic year” Statistical First Release[1].
