star this property answer text <p>The planning applications for new prisons next to HMPs Garth, Gartree and Grendon have been refused by the respective planning authorities. We have decided to appeal all of those planning refusals. As part of the evidence to those appeal inquiries, details of the site searches undertaken will be made publicly available.</p><p>The list of sites that were considered for the prison next to HMP Garth have been made available as part of that inquiry and can be found at: <a href="https://chorley.gov.uk/article/2612/Planning-appeals-HM-Prison-Wymott" target="_blank">https://chorley.gov.uk/article/2612/Planning-appeals-HM-Prison-Wymott</a> (document E1).</p><p>The proof of evidence in support of the new prison including the list of alternative sites considered at Gartree will be available after 6 September. The inquiry will run between 4 and 10 October 2022. The proof of evidence in support of the new prison at Grendon will be available in accordance with a timetable set by the planning inspector.</p><p>No decision has been made to change the number of new category C prisons from three to two.</p><p>The Deputy Prime Minister announced on 4 March this year that three of the four prisons will be run by the private sector and one will be run by the public sector. Planning permission has been granted for a category C prison at Full Sutton and construction of that prison is expected to commence in the summer. The MoJ has submitted planning applications for new category C prisons next to HMP Grendon Springhill and HMP Garth/Wymott in order to meet the forecast regional demand. A planning application has been submitted for a category B training prison next to the existing category B prison at Gartree in order to meet the forecast national need for category B places. The new prisons HMP Five Wells and HMP Fosse way will meet the regional demand for category C prisons in the Midlands.</p><p>As outlined above, planning for the new prison on land to the south of HMP Gartree is subject to an appeal process which is currently ongoing. The cost of the new prison can therefore only be finalised if planning permission is secured following the appeal process. If planning permission is granted an announcement will be made on the contract value and contractor who will take the project forward.</p>

star this property answer text <p>HMPPS are considering the findings of the IMB / CRA reports and will act accordingly. We recognise that race disparities persist in the Criminal Justice System, and we are committed to actively tackling the impact of this across MoJ. In December 2020 HMPPS launched the Race Action Programme, which will increase the diversity of our workforce, address the risk of bias in our policies and tackle disparity in outcomes for prisoners, people on probation and children in our system.</p><p>The Female Offender Strategy also included a clear commitment to look at how the distinct needs of ethnic minority and non-British national women can be better addressed. This is being taken forward by the Female Offender Minority Ethnic working group, which brings together officials and stakeholders to work together to improve outcomes for this cohort of women.</p><p>There is no place for racial abuse in prisons, which should be safe, orderly and decent places for both prisoners and staff. As set out in the Prisons Strategy White Paper we are introducing training for staff in women’s prisons to address the diverse needs of all women in their care. This will include cultural competence training to equip our staff with an increased knowledge of the effects of culture, faith and sustaining family relationships for ethnically diverse communities, increasing their confidence and skills in supporting all offenders, including those subjected to racial abuse.</p><p>Information on the number, grade and allocated duties of equality staff is not held centrally. The majority of HMPPS PGDs have a dedicated Regional Equality Lead (Band 8 &amp; Full Time) who coordinate activity and drive a regional strategy designed to best represent the unique situations arising in that part of the country, representative of the staff and prisoner population. Profiles for equalities work are decided at a local level to ensure they best fit the nature of individual establishments.</p>

star this property answer text <p>In England, the NHS is responsible for commissioning healthcare services in all prisons including integrated substance misuse services. The Ministry of Justice works with NHS England, the Department of Health and Social Care and the Welsh Government, to ensure all prisoners access treatment that meets their needs and to support a meaningful recovery from drug dependency.</p><p> </p><p>The Government is investing a record £780m in drug treatment and recovery over the 3-year Spending Review period, with the Ministry of Justice investing £120m of this to get more offenders across the Criminal Justice System engaged in treatment. With this investment, we will enhance testing regimes in prison, expand the use of Incentivised Substance-Free Living units where prisoners commit to remain drug-free and undergo regular drug tests, rollout Drug Recovery Wings to support people recovering from opiate addiction, and support prisoners to engage with community treatment ahead of their release.</p>

The name Youth Offender Panels is included in the legislation, but in practice Youth Offending Teams may (and do) already call them other names such as ‘Referral Order Panel’ or ‘Community Panel’. We have no plans to change the name of Youth Offender Panels in the relevant legislation.</p> more like this

star this property answer text <p>The current Prisoner Complaints Policy Framework was published in August 2019 and implemented across all prisons in England and Wales. There is a clear requirement within this for staff in all prisons to adopt a problem-solving approach, applying the ‘balance of probabilities’ level of proof when investigating complaints. Each complaint form gives the prisoner the opportunity to state what they want to see happen as a result of their complaint.</p><p>Prisons are required to complete routine checks of samples of complaint forms in order to assure the quality of responses. Her Majesty’s Prison and Probation Service works closely with the Prisons and Probation Ombudsman to share good practice and feedback and review assurance processes in relation to complaint responses.</p><p>Outside of this process, prisoners are also able to submit a Discrimination Incident Reporting Form, if they perceive that they have experienced, or witnessed, an incident of discrimination. This process is confidential, and each incident must be investigated via a designated process within a set timescale.</p>
