star this property answer text <p>In 2023, the Government passed the Seafarers’ Wages Act to address this issue. Based on data and assumptions used in the Seafarers’ Wages Act 2023 impact assessment (https://assets.publishing.service.gov.uk/media/62e2aa8ed3bf7f75af0923d5/seafarers-wages-impact-assessment.pdf), the Government’s most recent estimate is that 4,400 individuals working on services in scope of the Act (i.e. those working on international services calling at a UK port at least 120 times a year) may be being paid less than the UK national minimum wage. The secondary legislation that the Department is consulting on currently will bring the Act into force to address this issue.</p> more like this

star this property answer text <p>HMRC enforces the UK NMW and national living wage in line with the legislative framework owned by the Department for Business and Trade (DBT).</p><p> </p><p>HMRC don’t hesitate to use their powers if they suspect a business isn’t paying their workers at least the correct rate of National Minimum Wage. HMRC deploy resource across all sectors proportionate to the level of risk.</p><p> </p><p>Since the UK NMW changes for the maritime sector in October 2020, HMRC have worked with the domestic maritime sector and unions to ensure obligations and worker rights are understood and are being complied with. HMRC wrote to employers in the Maritime sector asking them to check that they are paying all their workers the correct minimum wage.</p><p> </p><p>HMRC have produced multi-lingual leaflets for seafarers regarding their entitlement and routes of redress and these have been distributed via the RMT and Nautilus International unions. star this property answer text <p>National Minimum Wage (NMW) legislation applies to those who work or ordinarily work in the UK, as well as to some workers on UK-registered ships. We have a proud record of ex-tending the NMW to seafarers.</p><p>In October 2020, legislation came into force to extend the minimum wage to all seafarers on domestic voyages in the UK territorial sea or UK section of the continental shelf.</p><p>We will continue to consider the needs of all sectors of the economy and take measures where these are needed, taking an evidence-based approach if any further changes to the NMW legislation are needed.</p> more like this

star this property answer text <p>Officials from the Department for Business, Energy and Industrial Strategy and the Low Pay Commission (LPC) speak to a wide range of stakeholders in relation to the National Minimum Wage (NMW) and its enforcement.</p><p>Almost all workers in the UK are entitled to be paid at least the NMW. This includes seafarers who ordinarily work within the UK and its territorial waters. HMRC takes a risk-based approach to enforcement, which means they can flex their resources to tackle an emerging threat or issue, including for seafarers working in the shipping industry.</p><p>HMRC will continue to enforce the NMW with this approach.</p> more like this

star this property answer text <p>All businesses, irrespective of size or business sector, are responsible for paying the correct minimum wage to their staff. HMRC does not stand for anyone failing to meet their obligation to pay at least the minimum wage.</p><p> </p><p>As of March 2022 HMRC had 390 full time equivalent National Minimum Wage (NMW) officers in post. star this property answer text <p>The Government is determined that everyone who is entitled to the National Minimum Wage (NMW) receives it.</p><p> </p><p>HMRC does not routinely publish sector specific data on NMW complaints received.
