Any worker who believes that they are being paid below the minimum wage should make a complaint to the Pay &amp; Work Rights Helpline (PWRH) on 0800 917 2368.</p><p> </p><p>HMRC review every complaint referred to them by the PWRH and, in addition, collate and analyse data from various sources to identify employers more likely not to be paying National Minimum Wage and undertake targeted enforcement against those employers.</p><p> </p><p> </p><p> </p><p>However, some complaints may not lead to the commencement of an investigation. This might be due to incomplete information being provided, or the worker subsequently wishing to withdraw their complaint. Similarly, multiple complaints about the same employer would only be recorded under one investigation. HMRC do not record statistics by complaints received, but by investigations completed.</p><p> </p><p> </p><p> </p><p>As stated above, HMRC review every complaint they receive from the PWRH. Any worker who believes that they are being paid below the minimum wage or is aware of an employer who does not meet NMW legislation should make a complaint to the Pay &amp; Work Rights Helpline (PWRH) on 0800 917 2368.</p><p> </p><p> </p><p> </p><p>HM Revenue and Customs (HMRC) are unable to comment on ongoing investigations.</p><p> </p><p> </p><p> </p><p>I refer the honourable member to the answer provided to him at UIN 212652 on how HMRC identify sectors and employers for targeted investigation and enforcement.</p><p> </p><p> </p><p> </p><p>Any arrears of pay due to workers are uprated to the current rate of NMW. The majority of employers identified as paying below the NMW will pay arrears on receipt of a formal Notice of Underpayment. Using this information, and often in conjunction with other Government Departments, HMRC have undertaken targeted enforcement on areas such as the care sector, car washes and the retail sector, amongst others.</p><p> </p><p> </p><p> </p><p>However, HMRC, including National Minimum Wage officials, undertake joint working with the police, Home Office and local authorities across the country. Anyone who feels they have been underpaid NMW should contact the Acas helpline on 0300 123 1100. HM Revenue &amp; Customs (HMRC) review all complaints that are referred to them.</p><p> </p><p>HMRC provides general information on NMW entitlement to workers who make a NMW complaint; this includes a worker’s right to pursue any NMW arrears through an employment tribunal and the applicable time limits. If HMRC opens an NMW investigation, regular updates on the progression of the case are provided to the impacted workers. 	answer	answer is ministerial correction date of answer 25/03/2015 answer text <p>The Government takes the enforcement of the National Minimum Wage (NMW) very seriously and has increased the financial penalty percentage from 50% to 100% of the unpaid wages owed to workers, and the maximum penalty from £5,000 to £20,000. These new limits are now in force where arrears are identified in pay reference periods on or after 7 March 2014. The Government will also bring in primary legislation as soon as possible so that the maximum £20,000 penalty can apply to each underpaid worker.</p><p> </p><p> </p><p> </p><p>UIN 220731 makes reference to 94 care sector employers who are currently being investigated. As investigations are ongoing, it is not possible to provide the information requested.</p><p> </p><p> </p><p> </p><p>To be clear, HM Revenue and Customs (HMRC) review every complaint referred to them but these may not lead to a formal investigation.
