Work trials may only be unpaid if they are part of a genuine recruitment exercise. An unpaid trial work period lasting a few hours may be reasonable and legal, but an unpaid work trial lasting more than one day is probably excessive and therefore illegal in all but exceptional circumstances. The Government has consulted with employers and trade unions on how to ensure greater clarity and better practice over work trials. We expect such persons to leave voluntarily but where they do not, we will seek to enforce their departure.</p><p>Individuals may raise Article 8 human rights grounds why they should not be removed from the UK and this must be considered, including their age on arrival in the UK and the length of time spent in the UK if that is part of their claim.</p><p>There is a right of appeal against an adverse decision. Where an Article 8 claim is made, consideration is given to the public interest in deportation to determine if it is outweighed by a foreign criminal’s private or family life. However, we understand that if in the unlikely event that the UK leaves without a deal, customs declarations will become a new obligation for UK-EU trade which could affect many small and medium sized businesses.</p><p> </p><p>HMRC continues to engage with businesses and their representative trade bodies and undertakes further specific engagement to understand how they will be affected by these new obligations. HMRC has written to 145,000 traders over the VAT threshold who currently only trade with the EU to help them plan for a no deal scenario. My officials are however in regular dialogue with the tourism sector to understand potential implications. This includes recently meeting with Visit Kent.</p><p>We have agreed in principle the terms of the UK’s smooth and orderly exit from the EU, as set out in the Withdrawal Agreement. We have also agreed the broad terms of our future relationship as set out in the outline Political Declaration.
