Racial aggravation increases an offender’s culpability under the guideline and therefore the starting point and sentence range for the court to consider.</p><p>Prosecutors should assist the Court as necessary during the sentencing process, including drawing the Court’s attention to any relevant sentencing guidelines and the aggravating and mitigating features of the case.</p><p>Ultimately, sentencing is a matter for the court. However, latest figures from the Home Office for all types of terrorism cases (which includes Foreign Terrorist Fighters) show that last year 84 people were tried following charges brought by the CPS for terrorism-related offences, resulting in 76 convictions. 	answer	answer is ministerial correction date of answer 22/03/2018 answer text <p>Tackling hate crime is a priority for the CPS and it has taken a number of steps to improve the effectiveness of prosecutions.</p><p> </p><p>The CPS Hate Crime Annual Report shows that the proportion of cases where the CPS was successful in achieving uplifted sentences for hate crime perpetrators increased dramatically last year. The proportion rose from 33.8% in 2015/16, to 52.2% in 2016/17 – reaching 58.2% in the final quarter.</p><p> </p><p>The CPS has delivered mandatory face to face disability hate crime training and racially and religiously aggravated hate crime training, and is in the process of delivering homophobic, biphobic and transphobic hate crime training. In August 2017, the CPS published revised legal guidance for prosecutors on all strands of hate crime. 	answer	answer is ministerial correction date of answer 08/05/2019 answer text <p>The Crown Prosecution Service (CPS) maintains a central record of the number of suspects referred to prosecutors for a pre-charge decision and the number of decisions not to prosecute suspects following the charging decision.</p><p>When prosecutors make decisions on cases, they refer to The Code for Crown Prosecutors. The Code contains a two stage test which has to be met before a suspect can be charged; the evidential stage followed by the public interest stage. When deciding whether there is enough evidence to charge, prosecutors must consider whether evidence can be used in court and is reliable and credible, and there is no other material that might affect the sufficiency of evidence. Prosecutors must be satisfied there is enough evidence to provide a &quot;realistic prospect of conviction&quot; against each defendant. At the public interest stage the prosecutor must consider whether a prosecution is required in the public interest.
