We are clear that unsafe ACM cladding must be replaced swiftly. Where insufficient progress is being made, building owners can expect further action to be taken – including enforcement. In the Queen’s Speech, the Government announced legislation which will put beyond doubt that the Fire Safety Order applies to external walls (including cladding) and individual flat entrance doors in multi-occupied residential buildings. This will affirm Fire and Rescue Services’ enforcement role for these buildings.</p><p>Where the government has funded the removal and replacement of unsafe ACM cladding, a condition of funding is that applicants are expected to take all reasonable steps to recover the cost of replacing unsafe ACM cladding from those responsible. The Department is aware that the form is being requested on a wider number of buildings than was the original intention. We do not hold the relevant information for any buildings with other rainscreen cladding systems. We can confirm that as of 12 October 2018 there are 62 high-rise (over 18 metres) private sector student accommodation buildings in England with ACM cladding systems unlikely to meet current Building Regulations guidance. The £600 million which the Government has committed to remediate high-rise residential buildings with unsafe ACM cladding removes the biggest blocker to pace of remediation.</p><p>The Department has regular engagement with a named contact from each building to ensure progress with remediation is being made. Building owners who have not already taken action, must do so now. Further delay is not acceptable. This funding should mean that banks and mortgage lenders have certainty that remediation costs for these buildings will be paid for. The Independent Expert Advisory Panel has provided clear advice to building owners who should take steps to remove unsafe ACM cladding regardless of height.
