The alert has been issued to relevant personnel across Defence, including to partners in Defence industry. MOD are also actively sharing information with key allies.

The MOD has no evidence that anyone has breached the high threshold of the Officials Secrets Act (OSA), but if any evidence were to be forthcoming, we would not hesitate to bring criminal charges. The Department takes this matter extremely seriously and are actively taking measures to deter future recruitment as well as engaging with the individuals already involved to ensure they are fully aware of the risk of prosecution under the OSA.

The Government's National Security Bill (led by the Home Office) will capture a range of relevant activity and provide additional possible routes to prosecution. A review of the use of confidentiality agreements is being conducted across Defence, with the aim of providing additional contractual levers to prevent individuals breaching security.

star this property answer text
The Ministry of Defence has been made aware of 37 cases from the original list of approximately 3,300 names submitted to the French authorities where the veteran had died before their case could be submitted. In addition, the French Embassy has advised us of 14 cases in which the medal has been sent out but was returned to them specifically because the individual had died.

Under the terms of the arrangement with the French authorities, within which the normal timetable for processing awards has greatly reduced, the Ministry of Defence can submit 100 cases per week. Cases are normally submitted in order of their original submission to the Department; but we prioritise cases where we are notified of life-threatening or serious conditions.

Since the new system began in July last year we have sent 3,150 applications to the French Embassy and it should be remembered that this alone is more cases than would normally be dealt with by the Legion d'Honneur in all categories for a whole year. The French are also receiving applications from the other Allied nations that took part in D-Day, and the overall level of applications will clearly be far higher.

In those specific circumstances where the Coroner might raise a Prevention of Future Deaths Report (PFDR or Regulation 28 report) the Ministry of Defence (MOD) may be asked, where relevant, if it can address any remaining concerns relating to the death. Both the PFDR and the MOD response to it are then usually published on the Chief Coroner for England and Wales website. The publishing of this report is down to the individual Coroner and the Chief Coroner's office.

The only other "report" produced by Coroners is known as a Record of Inquest (a one-page summary of the Inquest) will be offered to the Interested Persons at the conclusion of an Inquest.
