star this property answer text <p>The Social Security (Special Rules for End of Life) Bill received Royal Assent on 25<sup>th</sup> October 2022 and the Government will implement it as soon as is practicable.</p><p>The Act will enable people who are thought to be in the final year of their life to get fast-tracked access to Disability Living Allowance (DLA), Personal Independence Payment (PIP) and Attendance Allowance (AA). Similar changes were made to the definition of end of life used in Universal Credit and Employment Support Allowance in April 2022.</p> more like this

star this property answer text <p>When preparing an appeal response, the department will review the original decision, considering both evidence previously submitted to DWP and any new evidence submitted by the claimant in support of their appeal. A decision can be revised and the appeal lapsed on any ground which has the effect of changing the decision in the claimant’s favour.</p><p> </p><p>The aim of lapsing is to ensure that decisions which should be changed are identified at this stage, so that the claimant does not need to proceed to an appeal hearing. Where the change does not award the claimant the maximum they could be awarded by a tribunal, the appeal will only be lapsed with the claimant’s agreement.</p> more like this

star this property answer text <p>Personal Independence Payment (PIP), in line with the other extra costs disability benefits, Attendance Allowance and Disability Living Allowance, applies a habitual residence test and a past presence test whereby a claimant must have been present in Great Britain for 104 of the last 156 weeks to be entitled to payment. These rules operate to ensure that claimants, including British citizens returning from overseas, have a recent and long-standing association with Great Britain to justify receipt of a non-contributory, non means tested benefit funded by the British taxpayer.</p><p> </p> more like this

While the department holds data on a range of conditions, these are not collected centrally in a way that defines them as degenerative or not.</p><p> </p><p>Detailed statistics on PIP can be found on <a href="https://stat-xplore.dwp.gov.uk/" target="_blank">Stat-Xplore</a>. In particular, the PIP datasets on Award Reviews list the disability categories recorded on PIP. These cover over 500 conditions, but none are grouped or marked in any way as being degenerative. You can also view the disability categories <a href="https://stat-xplore.dwp.gov.uk/webapi/metadata/PIP_AR_COC_Clearances_post2016/Disability.html" target="_blank">here</a>.</p><p> </p><p>Guidance on how to use Stat-Xplore can be found <a href="https://stat-xplore.dwp.gov.uk/webapi/online-help/index.html" target="_blank">here</a>. star this property answer text <p>The table shows the number of Universal Credit (UC) claimants classified as having Limited Capability for Work (LCW), and those classified as having Limited Capability for Work Related Activity (LCWRA) across Great Britain on the second Thursday of each month from April 2019. The second Thursday of the month is used in the creation of our UC caseload information.</p><p> </p><p>Prior to April 2019, some UC claims were recorded on an interim operational system called UC Live Service (UCLS). star this property answer text <p>The table shows the number of Universal Credit (UC) claimants classified as having Limited Capability for Work (LCW), and those classified as having Limited Capability for Work Related Activity (LCWRA) across Great Britain on the second Thursday of each month from April 2019. The second Thursday of the month is used in the creation of our UC caseload information.</p><p> </p><p>Prior to April 2019, some UC claims were recorded on an interim operational system called UC Live Service (UCLS).
