star this property answer text <p>Whilst the application for the Short Term Benefit Advance must come from the claimant or their appointee, the Department acknowledges that representatives and key workers can be very helpful, both in supporting the individual, and by offering advice to staff on recognising support needs and how this impacts on the individual’s ability to access the Department’s benefits and services. Once the claimant has confirmed that they are willing to let the third party speak on their behalf, the Department will accept information from the third party.</p> more like this

star this property answer text <p>We only collect limited data on those requests for a Short Term Benefit Advances that are refused although we do know that the vast majority of refusals are either because:<br>(i) There was a doubt about whether the claimant would be entitled to the benefit being claimed and, therefore, we could not be sure that there was any benefit to advance or <br>(ii) Actual benefit was paid instead, which is a better outcome for the claimant.</p> more like this

star this property answer text <p>There are already a range of circumstances where work-related requirements should be switched off temporarily because people claiming Jobseekers Allowance (JSA) and Employment and Support Allowance (ESA) are experiencing difficult personal circumstances. This includes claimants experiencing a domestic emergency and claimant who are homeless or at risk of becoming homeless.</p><p> </p><p>For people claiming JSA with a physical or mental impairment (including those with cognitive or learning difficulties), work coaches may agree to tailor the number of hours, type or location of work depending on the claimants’ impairment. In addition, work search and availability requirements should be switched off to account for a period of sickness. Outside of these set periods, work coaches have the discretion to tailor requirements depending on what is reasonable based on the claimant’s health condition.</p><p> </p><p>People claiming ESA who are required to attend interviews or undertake work preparation activities should have requirements tailored to meet their individual needs, this would include deferring their interviews if appropriate and limiting the voluntary work preparation activity to fit their current capability.</p>

star this property answer text <p>The Department has previously investigated claims that Housing Benefit (HB) has been suspended or terminated as a result of a sanction being applied and has been unable to identify any evidence to support this assertion. No new evidence has been presented to suggest that this is happening.</p><p> </p><p>When a sanction is applied entitlement to benefits will continue but benefit will not be payable for a fixed period of time. If a claimant is in receipt of passported HB then payment should continue without interruption.</p><p> </p><p>If a claimant is disentitled to JSA or ESA then the local authority will issue an HB claim form to establish entitlement to HB only on low income grounds. The HB claim may be terminated if the claimant fails to respond to this request for information but this termination is not as a result of the sanction being applied.</p><p> </p><p>The Department continues to monitor payment of HB through an annual, independent audit of all 380 local authorities. This includes a check that all processes have been followed correctly. No audit has identified any example of claimants having their HB claim suspended inappropriately following a sanction being applied.</p><p> </p><p>The Department has committed to investigate any case where we are presented with evidence that HB has been suspended incorrectly following a sanction being applied.</p>

This includes signposting claimants to Gov.uk to check eligibility for alternative benefits. DWP also issues decision letters to claimants which include information on the options available to them during the mandatory reconsideration process, dependant on benefit. As DWP has responsibility for the mandatory reconsideration process, contractors will refer claimants to DWP to discuss benefit entitlement and options available.</p> more like this
