star this property answer text <p>The Government has recently commissioned three pieces of work looking into Network Rail:</p><p> </p><p>- Dame Colette Bowe is looking at what lessons can be learnt from the planning of the Control Period 5 programme in order to improve future rail infrastructure investment. This will report in September.</p><p> </p><p>- Sir Peter Hendy is looking at how we can put the current investment programme back on a sustainable footing. This will also report in the autumn.</p><p> </p><p>- Nicola Shaw will look to the future: advising the government on how it should approach the future shape and financing of Network Rail in the longer term. This will report in time for Budget 2016.</p><p> </p><p>The terms of reference for Bowe are available in the Libraries of the House.<ins class="ministerial"> Those for Shaw will also be placed in the Libraries of the House. Terms of reference for Hendy have not been published.</ins></p><p> </p><p><del class="ministerial">Terms of reference for the other two pieces of work have not been published.</del></p><p> </p><p>Network Rail and the Office of Rail and Road are also conducting their own reviews internally. Any terms of reference are held by the respective organisations.</p><p> </p>

star this property answer text <p>The independent regulator, the Office of Rail Regulation (ORR), is responsible for overseeing and enforcing Network Rail’s obligations, including the delivery of infrastructure projects. On 20 November ORR published its assessment, in the ‘Network Rail Monitor’, of Network Rail’s performance in the first two quarters of Control Period 5 (2014-19) covering the period 1 April to 11 October 2014. ORR reported that following a period of relatively successful delivery in Control Period 4 (2009-14) Network Rail has not made the expected progress in the early stages of certain enhancement projects in Control Period 5. ORR has asked Network Rail to produce an improvement plan to demonstrate how it will change its approach to make up for these delays and will hold Network Rail to account for its delivery. DfT is working extremely closely with ORR and Network Rail to ensure that the vital passenger benefits in the Rail Investment Strategy are delivered.</p> more like this

star this property answer text <p>There have been no general discussions between Her Majesty’s Government and Network Rail in relation to giving Network Rail additional compulsory purchase powers for the purposes mentioned. Her Majesty's Governmentand Network Rail from time to time discuss particular applications by Network Rail, under section 14 of the Railway Regulation Act 1842, in relation to obtaining temporary access to land neighbouring the railway, where this is needed for the purpose of certain safety works on the railway.</p><p> </p><p>Network Rail can also apply to Her Majesty's Government, under section 15 of that Act, for a revival of the compulsory purchase powers which would originally have applied under the enabling legislation for the relevant stretch of railway; again this would be where such acquisition is needed to be able to effect safety repairs and works. Each application by Network Rail under section 14 and 15 is considered on its specific facts and the safety issues arising.</p><p> </p><p>The powers of entry arising under section 14 of the 1842 Act were considered both by the Transport Resilience Review and the Powers of Entry Review under the Protection of Freedoms Act 2012. Following on from these Her Majesty's Government expects to consult with Network Rail and other stakeholders over a code of practice in relation to the use of section 14.</p><p> </p>

star this property answer text <p>The Framework Agreement sets out how the Department for Transport and Network Rail interact in terms of corporate governance and financial management. As set out in that document, the Department will be engaged by Network Rail during the production of several corporate planning documents, as is appropriate for a sponsoring Department, in order to agree the strategic approach:</p><p> </p><p>- Strategic Business Plans.</p><p>- The Delivery Plan.</p><p>- The Business Plan.</p><p>- Annual Plans.</p><p> </p><p>The Office of Rail Regulation regulates Network Rail’s stewardship of the national network in accordance with the Railways Act 1993. It continues to monitor and oversee Network Rail’s delivery of outputs, efficiency and financial performance against what it has challenged Network Rail to deliver in its Determinations that are developed through the Periodic Review process. The Determinations reflect Network Rail’s Strategic Business Plans amongst other things. The Department will not duplicate the Office of Rail Regulation’s work, but will oversee Network Rail’s performance on behalf of the UK taxpayer at a more strategic level, based on the Office of Rail Regulation’s analysis of performance and discussions with Network Rail’s Board.</p><p> </p><p>The Strategic Business Plans, Delivery Plan and Business Plan for Control Period 5 were finalised prior to the company’s reclassification to the public sector. Network Rail will continue to update its Plans for Control Period 5 on an annual basis.</p><p> </p>

The Office of Rail Regulation continues to monitor and oversee Network Rail’s delivery of outputs, efficiency and financial performance against what it has challenged Network Rail to deliver in its Determination for Control Period 5.</p><p> </p><p>The Framework Agreement between Network Rail and the Department for Transport sets out the new approach to governance, financing, accounting and budgeting following Network Rail’s reclassification to the public sector. It has been written with reference to “Managing Public Money”, the HM Treasury guidance on the principles for managing public resources.</p><p> </p><p>The Framework Agreement includes a requirement upon Network Rail to provide regular financial information, and to lay a copy of its accounts in Parliament.</p><p> </p>

Network Rail is continuing its discussions about the lease with all parties to find a way forward in the near future. star this property answer text <p>In the last Parliament, the Shareholder Executive conducted a high-level review of Network Rail’s governance which considered, among other things, the option of a Special Director being appointed to serve on the board. The review is part of advice for the ongoing formulation of government policy and therefore there are no plans to publish it. However I am considering all of its findings and will make any relevant decisions in due course.</p> more like this

star this property answer text <p>The Office of Rail and Road (ORR) is responsible for determining the efficient cost of Network Rail’s CP5 enhancement schemes, not the Department for Transport.</p><p> </p><p>As explained in my previous response to the Honourable Member for Nottingham South, the ORR publishes quarterly updates on the enhancements cost adjustment mechanism (ECAM) process. This includes information about efficiencies identified on specific schemes through the ECAM process. star this property answer text <p>The incoming Chair of Network Rail will receive £500,000 for four days work per week in the first two years of appointment and then £300,000 for a minimum two-day week during the next two years. This is comparable to the pay of the incumbent Chair on a pro-rata basis. This is a contract for services and not a contract of employment. There will be no pension benefit and no bonus. In total the incoming Chair’s pay will be less than his overall salary package at Transport for London.</p><p> </p><p> </p><p> </p><p>The role of Chair at Network Rail is a very significant leadership and delivery role. It comes with the challenge of recommending proposals for re-profiling the enhancements programme and taking clear responsibility for delivering it, at a time of strong passenger growth on the operational railway.</p><p> </p> more like this
