answer text
The Department’s guidance for schools on the Equality Act 2010 makes it clear that it is unlawful to discriminate against a pupil due to the disability of another person with whom the pupil is associated, such as a parent.

It is for individual admission authorities to decide which admissions oversubscription criteria to specify within the parameters of the School Admissions Code (The Code). The Code allows admission authorities to prioritise applications based on medical and/or social need. It does not specify that this must include a parent’s medical needs or disability. Schools can, however, lawfully adopt admissions criteria that consider the disability of parents.

The Department is aware of case law which states that appeals about admissions will be successful if inflexible application of the published admission arrangements to the circumstances of a particular child results in an admission decision which is perverse. We are currently considering how to ensure that admission authorities and independent appeal panels are aware of the relevant case law.

The Ofsted reports, the Financial Notice to Improve issued on 13 November 2015, and the Trust’s annual reports / financial statements are publicly available documents that provide an overall picture of the issues facing the academy trust. answer text
The estimated costs of a closure form only one element of a decision, which will take into consideration both the risks involved and dependencies required to deliver each of the options, and the best and most sustainable strategy for delivering good or outstanding school places for every child in the local area.

Releasing details of estimated closure costs could make factors that are equally influential in the arguments for and against closure seem less significant and give a misleading picture as to how the decision was made. The primary objective of the department in making such decisions is to secure value for money for the taxpayer whilst ensuring the best possible educational outcomes for the pupils and parents.

Releasing details of estimated closure costs would not provide a complete picture of the situation. In some cases, those details may also be commercially sensitive. The primary objective of the Department in making such decisions is to ensure the best possible educational outcomes for the pupils and parents whilst also securing value for money for the taxpayer.

This sought feedback on potential sale structures and key features of the transaction and informed the design of the sale. This was a commercial rather than a public process and was conducted under non-disclosure agreements. We do not intend to publish a report of the details.
