answer text <p>Schedule 2 of the Children Act 1989 mandates that local authorities should promote contact between the child and his or her relatives, where this is consistent with the child’s welfare and is reasonably practical. This includes sibling contact.</p><p> </p><p>However, the department agrees that there is an anomaly in the 2010 Care Planning Regulations and recognises that the honourable Member for South Shields has raised this issue in the past.</p><p> </p><p>In <em>‘</em>Stable Homes, Built on Love’, the department committed to a review of all legislation, regulations and standards of care to ensure all children in care receive what they need. Alongside this, the department will review the 2010 care planning regulations.</p> more like this

answer text <p>In July 2022, the department published updated guidance on the ‘Behaviour in Schools and Suspension and Permanent Exclusion’ statutory guidance. These documents provide clarity and support to schools on how to manage behaviour well for all pupils in the school community.</p><p> </p><p>Any school behaviour policy must be lawful, proportionate and reasonable and comply with the school’s duties under the Equality Act 2010 and the Education and Inspections Act 2006. Account must be taken of a pupil’s age, any Special Educational Needs or Disabilities they may have, and any religious requirements affecting them.</p><p> </p><p>Schools have a duty under the Equality Act 2010 to take such steps as is reasonable to avoid any substantial disadvantage to a disabled pupil caused by the school’s policies or practices. Within these legal parameters, it is then for individual schools to develop their own policies.</p><p> </p><p>As part of any graded inspection, Ofsted will make a judgement on behaviour and attitudes. If a school is judged inadequate for its overall effectiveness, this triggers powers to intervene to secure improvement. Where a school is judged to require improvement on two or more consecutive occasions, the department may also intervene. If there are any concerns regarding a school’s behaviour policy, these should be raised through the normal school complaints procedure.</p><p> </p><p>The department does not collect data on the impact of disciplinary policies on children who have a protected characteristic, identify as neurodivergent, or a mental health diagnosis.</p><p> </p><p>The National Behaviour Survey runs termly to track experiences and perceptions of pupil behaviour in schools and includes data on pupil’s perceptions on whether the rules on behaviour are applied fairly to all pupils. answer text <p>The department does not hold the data on what proportion of children suspended from school have mental health issues and/or are neurodivergent, which means this cannot be estimated. The department does, however, hold and publish data on the characteristics of pupils suspended from schools in England, including suspensions for pupils with Special Educational Needs and Disabilities (SEND) where categories of need will include those such as social, emotional and mental health needs and autistic spectrum disorder. These documents provide further clarity and support for head teachers on how to manage behaviour well for all pupils in the school community. The department’s guidance, 'Understanding your data: a guide for school governors and academy trustees’ also makes clear governing boards should carefully consider the level and characteristics of pupils who are leaving the school and deploy maximum challenge to the school on any permanent exclusions to ensure it is only used as a last resort. answer text <p>The government is clear that off-rolling (the practice of removing a pupil from the school roll without using a permanent exclusion, when the removal is primarily in the best interests of the school, rather than the best interests of the pupil) is unacceptable in any form and the department continues to work with Ofsted to tackle it.</p><p>Ofsted already considers records of children taken off-roll and their characteristics and have strengthened the focus on this in the revised inspection framework since September 2019. Where inspectors find off-rolling, this will always be addressed in the inspection report and, where appropriate, could lead to a school’s leadership being judged as inadequate.</p><p> </p><p>A pupil’s name can lawfully be deleted from the admission register on the grounds prescribed in regulation 8 of the Education (Pupil Registration) (England) Regulations 2006 as amended. All schools must notify the local authority when a pupil’s name is to be deleted from the admission register under any of the grounds prescribed in regulation 8 as soon as the ground for removal is met and no later than the time at which the pupil’s name is removed from the register. This requirement is intended to act as a safeguard to ensure children do not go missing from education.</p>

answer text <p>Secondary schools and colleges are expected to adopt the government’s careers framework, the Gatsby Benchmarks of Good Career Guidance, to develop and improve their careers programmes. The benchmarks describe eight aspects of high-quality careers guidance based on international evidence. A link to the guidance can be found here: <a href="https://www.gatsby.org.uk/education/focus-areas/good-career-guidance" target="_blank">https://www.gatsby.org.uk/education/focus-areas/good-career-guidance</a>.</p><p> </p><p>Gatsby Benchmark 6 sets out that every pupil should have first-hand experiences of the workplace through work visits, work shadowing and/or work experience to help their exploration of career opportunities and expand their networks. The criteria for meeting the benchmark are that by the age of 16, every pupil should have had at least one experience of a workplace, additional to any part-time jobs they may have. By the age of 18, every pupil should have had one further such experience, additional to any part-time jobs they may have. The proportion of schools and colleges fully achieving Gatsby Benchmark 6 has increased from 37% in 2017/18 to 64% in 2022/23.</p><p> </p><p>The department is funding The Careers &amp; Enterprise Company to support schools and colleges, through their network of local Careers Hubs, to deliver experiences of workplaces. Funding for 2023/24 will deliver three distinct strands of activity:</p><ol><li>High-quality work experience for up to 15,000 young people with the greatest economic disadvantage.</li><li>Experiences with 20 employers from key growth sectors for up to 5,000 young people with a guarantee of a high-quality mock interview.</li><li>Virtual experiences for year 7-9 pupils in up to 600 institutions in coastal and rural areas.</li></ol><p>The department will ensure that all of the learning and good practice from this work is disseminated widely and will inform future policy on work experience.</p>
