answer text <p>The Government published Sir Amyas Morse’s independent review of the Loan Charge on 20 December, alongside the Government’s response to his recommendations.</p><p>The Government accepted all but one of Sir Amyas’s recommendations. This means that out of the estimated 50,000 individuals who used a loan scheme between 1999 and 2019 and did not settle with HMRC before March 2016, it is estimated that more than 30,000 people will benefit from the significant package of measures announced, 11,000 of whom will be taken out of scope of the charge altogether.</p> more like this

answer text <p>The Government recognises that widespread free access to cash remains extremely important to the day-to-day lives of many consumers and businesses in the UK.</p><p> </p><p>LINK, the scheme that runs the UK’s ATM network, has put in place a Financial Inclusion Programme that includes premium fees for ATM deployers to protect remote free-to-use ATMs one kilometre or further from the next nearest free-to-use ATM or Post Office counter. LINK recently announced that £5 million would also be made available to fund requests for new ATMs from local areas with poor access to cash.</p><p> </p><p>Furthermore, UK Finance – the trade association for the UK banking and financial services sector – has launched a Community Access to Cash Initiative, offering grants to local communities to improve cash access where an ATM is not appropriate or required.</p><p> </p><p>The Payment Systems Regulator is closely monitoring developments in the ATM market and has used its powers to hold LINK to account over commitments to preserve the broad geographic spread of ATMs.</p><p> </p><p>The Government continues to engage with the Payments Systems Regulator via the Joint Authorities Cash Strategy Group, along with the Financial Conduct Authority and the Bank of England, to ensure comprehensive oversight of the overall cash infrastructure.</p>

answer text <p>National Savings &amp; Investments (‘NS&amp;I’) is required by regulations to notify its customers of their Premium Bond prizes. This ensures that customers are updated on their savings and are reassured around the security of their investments.</p><p>NS&amp;I notify its customers of their Premium Bond prizes by email, text message or post. Customers can also check whether they have won on the NS&amp;I website, prize checker app or Alexa Skill. NS&amp;I customers have the choice to receive their prizes either directly via BACS payments or by post. Since November 2019, NS&amp;I also offers BACS payments of prizes to customers who have registered their UK mobile phone number with its online and phone service.</p><p> </p><p>Additional support is offered to certain groups, including older and disabled people with additional needs. Under this process, such customers can opt to receive their Premium Bond prizes through BACS without needing an e-mail address.</p> more like this

answer text <p>The Check Employment Status for Tax (CEST) digital service was first released in March 2017. It helps customers apply the off-payroll working rules correctly.</p><p> </p><p>Following feedback from customers and stakeholders, HMRC released an enhanced version of the service on 25 November 2019. HMRC worked with over 300 stakeholders to identify and test the enhancements to ensure the service meets customer needs. These enhancements include making the questions and the results clearer, increasing the number of questions to provide a more thorough assessment and building in features to reduce user errors.</p><p> </p><p>Improvements have also been made to language and presentation, and HMRC have added guidance to ensure questions are clearly understood. CEST is accurate. It has been tested rigorously against known case law and settled cases. HMRC stand by its results if it is used in accordance with HMRC guidance and the facts put into CEST are correct.</p><p> </p><p>CEST currently provides an employment status determination for tax purposes in around 85% of uses, all bar the most complex or finely balanced cases. For these more complex cases, HMRC provide detailed guidance and dedicated support.</p>

The Government welcomes Sir Amyas’s recognition that Disguised Remuneration schemes are a form of tax avoidance and that it was right for the Government to take action to ensure the tax was collected.</p><p> </p><p>Sir Amyas’s careful and considered report examines the question of from when the Loan Charge should apply. He concludes that from 9 December 2010 the law about the tax treatment of loan schemes was clear and that the Loan Charge should apply from this date.</p><p> </p><p>The Government accepts Sir Amyas’s clear view on this point and intends to legislate to implement all but one of the recommendations in the next Finance Bill.</p> more like this
