In cases which the prison governor deems the rule-breaking to be sufficiently serious an Independent Adjudicator, appointed by the Chief Magistrate, can attend a prison to award additional days to the prisoner’s custodial time left to serve. Where an act of violence amounts to a criminal offence, prisoners should will be investigated by the police and face serious sanctions.</p><p> </p><p>Information on the proportion of adjudications which resulted in no additional days being added to a prisoner's time in custody by offence is not routinely extracted from the adjudications database, as the primary purpose of the database is to report on the volume of punishments imposed. Prisoners can receive more than one punishment for the same offence, so in order to collect this specific information on prisoners, a matching exercise using prison population and adjudication databases would be required to identify each individual prisoner who was sanctioned under the Prison Rules. answer	answer is ministerial correction date of answer 23/10/2019 answer text <p>HMPPS has been working closely with the police and the Crown Prosecution Service to ensure they understand the impact of crimes committed within prison. HMPPS published the revised Crime in Prison Referral Agreement in May 2019. This Agreement sets out how crimes in prison will be referred, investigated and prosecuted and aims to provide a more consistent approach to managing crimes committed within prison. The Crime in Prison Referral Agreement specifies that all assaults against members of staff, unless there is little or no injury should be referred to the police.</p><p> </p><p>It is not possible to identify the proportion of assaults on prison staff has been charged as an offence in each of the last five years as this information is not held centrally. answer	answer is ministerial correction date of answer 23/10/2019 answer text <p>The number of 28 day fixed term recalls to prison in England and Wales for the period 1 January 2018 to 31 December 2018 was <strong>4,665, </strong>this equates to <strong>19</strong>% of the total number of recalls for the period which was <strong>24,268</strong>.</p><p>Public protection is our priority. Offenders on licence are subject to strict licence conditions and supervision.</p><p>Where offenders are eligible for a fixed-term recall, they may be recalled to prison on a fixed-term basis, where that is a necessary and proportionate response to a breach of licence conditions. If not, they will receive a standard recall, which is the only type of recall available for those offenders ineligible for a fixed-term recall (such as those on a life licence). We acknowledge the importance of data collection to illuminate the prevalence and needs of those women prisoners with children, dependent or otherwise, as well as pregnancy, and to inform policy and practice in this area. Where an offender does choose to disclose, data is collected, although this data does not provide detailed information of the child’s age or whether they are dependents. However, the current system of safeguarding should capture children most at risk, including children for whom safe, alternative care arrangements have not yet been put in place.</p><p> </p><p>The government also recognises that the children of offenders can be disadvantaged, and we continue to explore ways in which to improve their lives and to adequately support their needs. answer	answer is ministerial correction date of answer 23/10/2019 answer text <p>Data on release on Childcare Resettlement Licence (CRL) is published regularly in the Offender Management Statistics:</p><p><a href="https://www.gov.uk/government/statistics/offender-management-statistics-quarterly-october-to-december-2018" target="_blank">https://www.gov.uk/government/statistics/offender-management-statistics-quarterly-october-to-december-2018</a></p><p> </p><p>Table A3.7 of <em>Prison Releases: 2018</em> shows that there were 32 incidences of release on CRL for men and 322 incidences of release on CRL for women. This is the number of releases rather than the number of individuals released, which is not available by type of release on temporary licence (ROTL).</p><p> </p><p>CRL is a form of ROTL which allows primary carers of children under 18 to be released to help maintain the relationship with their children. As with any ROTL there is a stringent risk assessment and the release must be in the child’s best interests.
