answer text <p>In deciding whether a live video and audio link is appropriate, and in operating these, we have ensured clear support and guidance are in place. This sets out that courts must have regard to the welfare of the child, must be satisfied that the mode of a hearing is compatible with the defendant’s right to a fair trial, and that the child is able to participate effectively. This is set out in criminal procedure rules and criminal practice directions. Effective use of virtual proceedings is also covered in ‘Good Practice for Remote Hearings’ guidance issued by the Judicial College, in the Equal Treatment Bench Book, as well as guidance by HM Court and Tribunal Service (HMCTS). The ways in which video technology is used in criminal proceedings are also kept under regular review by HMCTS.</p> more like this

answer text <p>HM Courts and Tribunal Service (HMCTS) published Management Information during the COVID-19 outbreak to help explain how we delivered critical public services, from June 2020 to June 2021 found here <a href="https://www.gov.uk/government/collections/hmcts-weekly-management-information-during-coronavirus-outbreak" target="_blank">https://www.gov.uk/government/collections/hmcts-weekly-management-information-during-coronavirus-outbreak</a>. In July 2021, we paused publication of this information while we conducted a review. Following this review, we stopped publishing data on a weekly basis as this is included in the monthly published data found here <a href="https://www.gov.uk/government/collections/hmcts-management-information" target="_blank">HMCTS monthly management information</a>.  Management information reflects the data held on the relevant case-management systems on the date of extraction, which is subject to change, and can differ from the quality-assured MOJ official statistics, which form the agreed definitive position. The published criminal court statistics can be found here <a href="https://www.gov.uk/government/collections/criminal-court-statistics" target="_blank">Criminal court statistics - GOV.UK (www.gov.uk)</a></p><p>At present there are no plans to disaggregate youth data in the published statistics.</p>

answer text <p>In April 2020 the National Police Chiefs’ Council (NPCC), Crown Prosecution Service, The Law Society, Criminal Law Solicitors’ Association and London Criminal Courts Solicitors Association agreed a joint protocol to facilitate the provision of remote legal advice for suspects being interviewed under caution in police stations during the pandemic. As a contingency measure, the Legal Aid Agency (LAA) agreed temporarily to pay for remote police station work as if it were provided in person.</p><p> </p><p>From 17 May 2021 children under 18 and vulnerable adults were removed from the scope of the protocol and receive in-person advice.</p><p> </p><p>The protocol is expected to be modified further shortly, at which point legal advice will be provided in person at a police station and in interview other than in rare and extraordinary circumstances (as defined in a revised protocol).</p> more like this

answer text <p>There are no plans to re-open this court and we are working with the local council to find an alternative use for the former court property.</p><p> </p><p>Hartlepool Magistrates’ and County Court closed in 2017 following a full public consultation and workloads were successfully transferred to Teesside Magistrates’ Court and Middlesbrough County Court.</p><p> </p><p>We will continue to keep our court and tribunal estate under close review to make sure it meets our operational requirements.</p> more like this
