answer text <p>The Judicial Appointments Commission (JAC) is the executive non‑departmental public body, sponsored by the Ministry of Justice, which selects candidates for judicial office in courts and tribunals in England and Wales, and for some tribunals whose jurisdiction extends across the UK, up to and including the High Court and Upper Tribunal.</p><p> </p><p>JAC’s selection panels for selections up to and including the High Court and Upper Tribunal, usually consist of a lay panel chair, an independent lay member and a judicial member (nominated by the judiciary). Of those who declared diversity information, 62% of JAC lay panellists are female and 8% are from a Black, Asian or Minority Ethnic (‘BAME’) background.</p><p> </p><p>People making nominations to the selection panels for senior posts and the UK Supreme Court must have regard (alongside other relevant considerations) to the fact that it is desirable that the panel should include both women and men and members drawn from a range of different racial groups (as defined by the Equality Act 2010)</p><p> </p><p>I also refer to my honourable friend to my answer to PQ 128124, in which she asked the Secretary of State for Justice, what steps the Government is taking to increase judicial diversity.</p>

answer text <p>The Lord Chancellor has a joint statutory duty with the Lord Chief Justice and the Judicial Appointments Commission to encourage judicial diversity.</p><p> </p><p>The MoJ is working with the Lord Chief Justice and the Judicial Appointments Commission to consider all practical actions that would impact positively on diversity, assess the impact of our existing activities and measure progress.</p><p> </p><p>The MoJ also strongly supports the work of the Judicial Diversity Forum which coordinates action by MoJ, the Judicial Appointments Commission, the judiciary and the legal professional bodies to increase judicial diversity. The Judicial Appointments Commission, judiciary and legal professions undertake a range of outreach events, shadowing programmes, pre-application support and mentoring to attract and support eligible candidates, which includes programmes specifically targeted at underrepresented groups to encourage applications from diverse applicants.</p> more like this

answer text <p>The victim personal statement (VPS) provides victims with a valuable opportunity to tell the Court or Parole Board in their own words how the crime has affected them and their family, and in the case of the Parole Board, what the impact of a prisoner’s release or move to open conditions would have on them.</p><p> </p><p>Her Majesty’s Prison and Probation Service does not hold centrally data on the number of victims who either made a VPS at the point of sentence or who made a VPS to the Parole Board and who qualified for the statutory Victim Contact Scheme. The data could be obtained only at disproportionate cost.</p><p> </p><p>On 9 January, the Secretary of State for Justice, the Rt Hon David Gauke MP, announced in a statement to the House that he would review the case for transparency in the process for parole decisions, how victims are communicated with, and how they are appropriately engaged in that process.</p><p> </p> more like this

answer text <p>The information requested is not held centrally.</p><p> </p><p>We asked the CPS to analyse a sample of rape cases finalised in 2016 to assess the frequency and outcome of applications to introduce evidence of a complainant’s sexual history under s 41 of the Youth Justice and Criminal Evidence Act 1999.</p><p> </p><p>A section 41 application was made by the defence in 13% of the 309 cases looked at. In 8% of the 309 cases, an application to permit such evidence was granted by the court.</p><p> </p><p>These are <strong>not</strong> official published statistics.
