answer text <p>In response to the current pandemic, video hearings provide an additional channel for conducting a hearing. However, they may not be suitable for everyone. The decision to hold a hearing by video is for the judge, panel or magistrate, taking into account the needs of the parties, including any disability or difficulties with access.</p><p> </p><p>Participants are asked to tell the court or tribunal if they need support or cannot participate effectively in the video hearing. The judiciary will consider reasonable adjustments or alternative arrangements to ensure disabled users can participate. For a participant without access to the internet they can access a video hearing by telephone, or the judiciary may decide it’s more appropriate to hold a face to face hearing.</p><p> </p><p>The judiciary and HMCTS staff have access to reasonable adjustment guidance and training. All guidance raises awareness of the issues people may face, and the reasonable adjustments which may help them to fully participate in hearings.</p>

answer text <p>We are unable to publish the Oasis application documents as had been intended as it has not been possible to produce it in an accessible format as required for all documents published on GOV.UK. A copy of the application and related documents in the form it had been intended to be published will be placed in the House library. We have made the document available on request as stated on the page providing guidance on secure schools.</p><p><a href="https://www.gov.uk/government/publications/secure-schools-how-to-apply" target="_blank">https://www.gov.uk/government/publications/secure-schools-how-to-apply</a></p><p> </p><p>The application submitted by Oasis in March 2019 outlined the foundation for their operating concept and proposed principles for the secure school, in line with the criteria set out in the secure schools ‘how to apply’ guide. Since they were approved as the successful applicant for the first secure school in July 2019, Oasis have continued to develop and refine their operating model. All policies submitted by Oasis were accurate for academic year 2018-19.</p>

answer text <p>When a left-behind parent applies to the court for the return of a child under the 1980 Hague Child Abduction Convention, and where the taking parent opposes return, the taking parent can bring evidence before the court that there is a grave risk that the child’s return would expose the child to physical or psychological harm or otherwise place the child in an intolerable situation. The decision is for the court on the evidence put in front of it. In such cases, the court will consider evidence of an abusive relationship which has affected the child.</p> more like this

answer text <p>The national policy on the searching of prisoners, staff and visitors (PSI 07/2016 – Searching of the Person) is currently under review and a revised version is intended to be published later this year. Due to the anticipated lengthy discussion and consultation process, there is not a set timeline at this stage.</p><p> </p><p>In reviewing the policy, Her Majesty’s Prison and Probation Service (HMPPS) has consulted with the Government Legal Department and HMPPS Equalities Team. Further consultation will be undertaken with contributing groups including HMPPS women’s group. The new policy will be compliant with the Equality Act 2010, Gender Recognition Act 2004 and the European Convention on Human Rights.</p> more like this

answer text <p>No data is held centrally on the number of prisoners or prison staff with Gender Recognition Certificates (GRCs) in English and Welsh prisons. Neither group is obliged to disclose that they have a GRC.</p><p> </p><p>Her Majesty’s Prison and Probation Service and the Ministry of Justice are actively pursuing ways to improve data relating to gender and gender identity, whilst also continuing to respect the rights and privacy of those who hold Gender Recognition Certificates. This year's transgender annual data collection exercise will, for the first time, collect anonymised information on the number of prisoners known to hold GRCs in the prison estate and this information will be published within the Offender Annual Equalities Report in the autumn.</p> more like this

answer text <p>The government has no plans to review the use of the Single Justice Procedure for these offences.</p><p> </p><p>This is a quicker and more straightforward procedure for prosecutors dealing with these types of cases, and there are clear safeguards in place which ensure that it is only used in appropriate circumstances. A defendant must agree to this process being used and they always have the option to instead have their case heard in open court. A magistrate can also refer a case to open court if they deem it would not be appropriately dealt with using the Procedure.</p> more like this

answer text <p>The terms of reference for the Youth Custody Service Independent Restraint Review Panel are attached. In order to provide the names of the panel members, we would need to obtain individuals’ permission, and therefore I will write to the Honourable Member once this has been received.</p><p>An application has been made by the Ministry of Justice Appointments Team for the Chair to be a direct appointment, subject to ministerial approval, who will lead on the application process for subsequent appointments. The terms of reference have been agreed and signed off by the current panel. A meeting is held fortnightly to review progress.</p> more like this
