answer text <p>The Ministry of Justice does not hold data relating to whether individual cases were taken out on a vexatious basis, as there is no statutory definition for this. In addition, data relating to domestic abuse cases handled by the family courts does not identify whether the applicant has previously been a perpetrator of domestic abuse.</p><p> </p><p>However, it is unacceptable for someone to use court processes to harass or abuse a former partner. The family court has wide powers to manage such situations, including striking out an action it views as an abuse of process, and the power to prevent a person from making further applications without prior permission of the court.</p><p> </p><p>This Government is committed to transforming the response to domestic abuse, and the recently published draft Domestic Abuse Bill and consultation response set out our ambitions in this area. We want to ensure that victims have the confidence to come forward and report their experience, safe in the knowledge that the justice system and other agencies will do everything they can both to protect and support them and their children and pursue their abuser.</p>

answer text <p>I am only able to respond in relation to special measures that are available in criminal justice, family and civil proceedings in England and Wales.</p><p> </p><p>In the criminal courts, complainants of offences which involve domestic abuse are eligible for special measures as ‘intimidated witnesses’ if the quality of their evidence is likely to be diminished by reason of fear or distress as a result of testifying in the proceedings. They may also be eligible as ‘vulnerable witnesses’ if they are under 18 or the quality of their evidence is likely to be diminished by reason of a mental or physical disability or disorder.</p><p>In the civil and family courts, parties can apply to the judge for protective measures such as screens and videolinks and over the last year staff have received training on providing additional measures such as separate entrances, exits and waiting rooms.</p><p> </p><p>We are considering how best to build on the recent improvements we have made in this area and we have recently consulted on creating a legislative assumption that all victims of domestic abuse are eligible for assistance on the grounds of fear and distress in criminal proceedings. We have also sought views on what more the Government can do to support victims and will be publishing a formal response to the Consultation (Transforming the Response to Domestic Abuse) in the autumn 2018.</p><p> </p><p>The government has published its Victims Strategy, which commits to improving the support and protections available to all victims of crime.</p>

answer text <p>The government is committed to making sure that victims of crime have access to a broad range of support services, to help them cope with and, as far as possible, recover from the effects of crime. In 2016/17 we spent about £96m to fund support services for victims of crime.</p><p> </p><p>Just over £3.2m of this was allocated to Greater Manchester and about £64.4m was allocated to all Police and Crime Commissioners in England to locally commission or provide support services for victims of crime, including for victims of offences related to domestic abuse.</p><p> </p><p>In 2016/17 Greater Manchester reported spending just under £0.7m on services to support victims of domestic abuse and Police and Crime Commissioners in England reported spending about £11.1m on services to support victims of domestic abuse.</p> more like this

answer text <p>The new electronic monitoring system under development will introduce GPS enabled location monitoring and is being designed on a flexible and scalable platform to allow for further new monitoring technologies to be introduced. The introduction of new monitoring technologies after the new system is in service in 2019 will depend on the evaluation of the benefits any new technology would provide. The learning from two alcohol monitoring schemes currently being piloted in the country will help inform any future decision to roll out alcohol monitoring technology nationally.</p> more like this

answer text <p>We recognise that female offenders often have complex circumstances, including backgrounds of domestic abuse, and we are committed to addressing their needs. We are developing a strategy to improve outcomes for female offenders in the community and in custody.</p><p> </p><p>We are taking steps to provide assistance for women engaged with the criminal justice system who have experienced domestic abuse. This includes a confidential 24-hour helpline, run by Refuge and Women’s Aid, which is available in all women’s prisons and provides practical and emotional support and advice.</p><p> </p><p>We have also invested £1m between 2016 and 2020 to support local areas to develop holistic, multi-agency approaches which aim to address the complex needs of female offenders and women at risk of offending, including those who have suffered domestic abuse.</p><p> </p><p>We are committed to publishing a draft Domestic Violence and Abuse Bill. This will be accompanied by a programme of non-legislative work, and an additional £20m of funding to support victims of domestic abuse. Our aim is that all victims and survivors of domestic abuse will benefit from measures brought forward following consultation, including women engaged with the criminal justice system.</p>
