answer text <p>The Government has published a guide on Managing the safety of Burial Ground Memorials (<a href="https://assets.publishing.service.gov.uk/media/5a7d7910e5274a676d532467/safety-burial-grounds.pdf" target="_blank">Managing the safety of Burial Ground Memorials - Practical advice for dealing with unstable memorials (publishing.service.gov.uk)</a>); and a Guide for Burial Ground Managers (<a href="https://assets.publishing.service.gov.uk/media/5a7e0743ed915d74e6223a35/burial-ground-managers.pdf" target="_blank">8430_Burial Ground Managers (publishing.service.gov.uk)</a>) which provides guidance to local authorities on managing burial grounds.</p><p> </p><p>These documents provide best practice guidance on the appropriate procedure where maintenance to a gravestone or memorial is required. Where removal of a gravestone or memorial is being considered, the guidance emphasises the importance of communication with the family of the deceased and the local community. This includes giving appropriate notice so that the bereaved family may make alternative arrangements if they wish.</p>

answer text <p>The Government is responsible for law and policy relating to burial in England and Wales only. It does not have day-to-day operational responsibility for burial grounds, which is matter for local authority and private burial authorities.</p><p>I understand this initiative has been implemented in Derry and Strabane by the local authority and has previously been taken up in other parts of the UK. It would be a matter for individual burial authorities to decide whether they wish to implement the scheme.</p> more like this

answer text <p>Paragraph 2.23 of <em>Burial Grounds: Guidance for Managers</em> refers to section 214 of the Local Government Act 1972. Subsection 214(6) provides that a local authority burial authority may contribute towards the provision or maintenance of any cemetery in which their inhabitants are buried. For the purposes of section 214(6), the definition of “cemetery” (in subsection 214(8)) is “a burial ground or any other place for the interment of the dead (including any part of any such place set aside for the interment of a dead person’s ashes).” This would include a churchyard if it is used as a burial ground.</p> more like this

The Law Commission is working to prioritise this project, with a view to commencing it later this year subject to completion of current work.
