answer text <p>Information on the Windrush Compensation Scheme claims that have been (a) accepted and (b) rejected, to date is available to view on GOV.UK at:</p><p><a href="https://www.gov.uk/government/publications/windrush-compensation-scheme-data-november-2020" target="_blank">https://www.gov.uk/government/publications/windrush-compensation-scheme-data-november-2020</a></p><p>Our priority remains to process claims as quickly as possible. However, the Home Office does not have a set time within which claims are to be resolved. This is because the Windrush Compensation Scheme has thirteen claim categories, each individual’s compensation claim is deeply personal and requires detailed consideration to understand their circumstances and experiences. This enables the Home Office to make an individualised assessment of the value of compensation to be awarded. Some individuals’ experiences are more complex than others and it is right we take the time to ensure these are considered carefully. This holistic approach necessarily takes time, but is ultimately beneficial to individuals.</p><p>In some cases, we will make interim payments on parts of the claim that are straightforward to determine, such as immigration fees, thereby speeding up the provision of compensation.</p>

answer text <p>The Windrush Compensation Scheme awards compensation according to both actual losses and tariff-based awards. Where awards are for actual losses it is right we seek to obtain an appropriate level of assurance these losses were incurred in order to fulfil our duty to properly manage taxpayers’ money.</p><p>However, we do not expect people to meet the criminal standard of proof. We therefore published revised Windrush Compensation Scheme rules and guidance in October which clarify that the scheme operates on the balance of probabilities. This means caseworkers must be satisfied it is more likely than not that the losses and impacts being claimed for were suffered due to difficulties evidencing lawful status. We are working through more detailed changes to the ‘Loss of Access to Employment’ category to enable the actual losses section to be operated on the balance of probabilities as well.</p> more like this

answer text <p>The comprehensive improvement plan set out the aim to review all the compliant measures and cumulatively. We are currently in the discovery and scoping phase of the review.</p><p>There are six primary streams to the compliant environment – some of which only apply to England and Wales – which will be covered in our response to this recommendation. These are:</p><ul><li>Work – to prevent those who are ineligible from working;</li><li>Housing – to prevent those without lawful status from accessing the private rental sector.</li><li>Public Funds – to prevent those who are ineligible from accessing mainstream support and benefits;</li><li>Health – to charge upfront for non-urgent health care and recover costs for emergency treatment where payment upfront was not possible;</li><li>Financial Services – to prevent people deemed as disqualified due to lack of lawful status from accessing current accounts;</li><li>Driving – to prevent those without lawful status from holding licences while in the UK.</li></ul><p>A full evaluation of the Right to Rent scheme is already underway. The evaluation includes a call for evidence to tenants, landlords and letting agents; a large mystery shopping exercise; and surveys of landlords. Members of the right to rent consultative panel provided input into the design of the evaluation. COVID-19 has impacted the field work and delivery of the final implementation report is now scheduled for spring 2021.</p>

answer text <p>All interpreters are subject to qualification checks when joining the Home Office interpreter panel and performance is regularly monitored and assessed. Interpreters are also governed by a Code of Conduct that clearly sets out requirements and expectations. Any breaches of standards are rigorously investigated, assessed and appropriate action taken.</p><p>A revised version of the Code of Conduct was published in November 2020. We are also in the process of revising our sexual orientation guidance for caseworkers, which will highlight and enhance these requirements.</p> more like this
