The law protects children through restricting sales of vapes to over 18 years olds only, limiting nicotine content, refill bottle and tank sizes, labelling requirements and through advertising restrictions.</p><p>However, given the changing circumstances surrounding vapes, the Office for Health Improvement and Disparities has launched a call for evidence to identify opportunities to reduce the number of children accessing and using vape products. The call for evidence will close on Tuesday 6 June. The latest, ‘Nicotine vaping in England: 2022 evidence main findings’, was published in September 2022.</p><p>The report concludes that in the short and medium term, vaping poses a small fraction of the risks of smoking, but that vaping is not risk-free. This found that in 2021, 9% of pupils aged 11 to 15 years old were current vapers, compared to 6% in 2018, and 4% were regular users, compared to 2% in 2018. It is illegal to sell vapes to those aged under 18 years old and we continue to work with enforcement agencies to ensure these regulations are being enforced in England.</p><p>In order to raise awareness of the risks of vaping to children, we have recently updated information and advice on the Better Health and Talk to Frank online platforms. However, we are considering the recommendations made in ‘The Khan review: making smoking obsolete’, including measures to prevent young people and non-smokers from starting to vape.</p><p>No assessment of the potential merits of increasing the level of fines for underage sales of vaping products has been made. Under the regulations, if an individual is found guilty of selling nicotine inhaling products to a young person under 18 years old, they may be fined up to £2,500.
