answer text <p>The Child Maintenance Service (CMS) is required to consider the circumstances of the paying parent when scheduling how and when payments are to be made. By setting payments in line with a paying parent’s preferred payment date and frequency, the paying parent is more likely to make the required payments on time.</p><p> </p><p>Before a payment is considered as ‘late’ or ‘missed’, the CMS allow an additional 5 days for payment to be received (either into CMS or direct to the receiving parent). This timescale is applied as different payment options, for instance direct debit, standing order or cheque, all have set clearance times. These clearance times are set by banks and are outside of CMS control. Clearance times can vary from bank to bank and can be affected by the type of account they are made from or to. Clearance times apply to banking or working days and it would not be right to penalise a paying parent if their usual payment date falls on a bank holiday or weekend as their payment would not be processed by the bank. There is no current plan to change the period before which a payment is considered late, though as banking processes evolve we will keep this under review.</p>

answer text <p>The Child Maintenance Reforms are designed to support parents to make collaborative child maintenance arrangements where possible. This is why cases within the Child Support Agency are being closed rather than automatically moved to the Child Maintenance Service; at this point parents have the ability to choose the statutory service or make a family based arrangement. Applications to the Child Maintenance Service are subject to an application fee (except where domestic violence is reported) and on-going charges for collect and pay. The Child Maintenance Options service supports parents to make the right choice about child maintenance for their individual circumstances; this may be outside the statutory scheme through a family based arrangement. Our review of charging and its impact was published in August 2017.</p> more like this

answer text <p>The Child Maintenance Service introduced collection and enforcement fees to encourage parents to make a collaborative arrangement and incentivise compliance.</p><p> </p><p>If a paying parent fails to pay on time or in full, we aim to take immediate action to re-establish compliance. If necessary we can deduct on-going maintenance and arrears directly from earnings or from solely held bank accounts.</p><p> </p><p>We also have a range of other strong civil enforcement powers including seizing property, removal of driving licences and commitment to prison.</p> more like this

answer text <p>The Child Maintenance Service understands how important it is to ensure that the system works for everyone, including victims of domestic violence and abuse. But we do not believe that a history of domestic violence and abuse has to be a barrier to using the Child Maintenance direct pay service.</p><p> </p><p>When parents have a direct pay arrangement, caseworkers can act as an intermediary and pass information between parents, including bank details, so that the parents do not need to have any contact with each other.</p><p> </p><p>They will also provide information about how to set up a bank account with a centralised sort code, which means that it gives no indication of the possible location of the account holder. Parents can also choose to have the money paid into someone else’s account.</p> more like this

answer text <p>The Child Maintenance Service calculates maintenance liabilities as a percentage of gross weekly income. Using gross annual income data directly from HMRC enables maintenance calculations to be made more quickly and ensures that the income information is as accurate and up to date as possible.
