answer text <p>During the time-limited implementation period, EU law will continue to apply in the UK subject to the terms set out in the Withdrawal Agreement.</p><p>After the implementation period, all laws in the UK will be passed by our elected representatives in Belfast, Cardiff, Edinburgh and London. The Political Declaration recognises that the UK may choose to align with the EU’s rules in relevant areas to facilitate trade in goods or security cooperation.</p><p>In the unlikely event that the backstop were to come into effect, a small fraction of EU rules applying today would apply in Northern Ireland and EU rules on state aid would apply in the UK. However, as the Withdrawal Agreement and the Political Declaration make absolutely clear, we do not want or expect the backstop to be needed – and even if it ever were ever to come into effect, it would be strictly temporary.</p><p>The Official Journal of the European Union publishes upcoming EU legislation for implementation. answer text <p>The Government has agreed in principle the terms of the UK’s smooth and orderly exit from the EU, as set out in the Withdrawal Agreement. The UK has also agreed with the EU the broad terms of our future relationship as set out in the outline Political Declaration.</p><p> </p><p>This includes a commitment to agree bilateral arrangements with Member States to ensure the continued smooth functioning and operation of services through the Channel Tunnel.</p><p> </p><p>The Government is engaging with a range of European counterparts, including relevant Member States, in relation to the continued operation of cross-border rail services, following preparations for the UK’s withdrawal from the EU. These discussions are ongoing and include consideration of arrangements needed both following the implementation period, as well as preparations for the unlikely event of no deal.</p><p> </p><p>The Government is committed to supporting the continued success of the Channel Tunnel, including rail freight services that run through it, and we want to see these grow in the future.</p><p> </p><p>The arrangements we are seeking to negotiate bilaterally are intended to ensure that both current operators of passenger and freight services, and any prospective operators seeking to run new services in future, can do so as seamlessly as possible.</p><p> </p>

answer text <p>The uniqueness of the UK rail industry is characterised by its long history of market liberalisation and competition, with more private operators than any other EU country and with parts of our network running to almost full capacity. answer text <p>In a no-deal scenario, the UK will be a third country unbound by EU law. UK technical specifications for interoperability will be published by the Secretary of State for Transport, and the European Commission will not hold liability for their content. The UK will also have the flexibility to align with or diverge from new technical standards developed by the EU after exit. We will only diverge where there are clear arguments for doing so and after engaging fully with industry to assess the impact. The Department is currently considering issues relating to liability for UK technical standards and continues to engage closely with stakeholders on this point.</p><p> </p> more like this

answer text <p>The UK ports sector is in an excellent position to facilitate growth in trade, both from the EU and from other countries, after we leave the EU. Several ports have invested strongly in capacity, to handle the largest container ships in global fleets and to adapt to changing patterns of energy generation. answer text <p><strong> </strong></p><p>The Government and EU have agreed the text of a Withdrawal Agreement which includes provision for a transition or implementation period after we leave the EU. During this period flights will continue as now. We have also agreed a Political Declaration on the broad terms of our future relationship with the EU. This confirms that the future relationship for aviation will be set out in a Comprehensive Air Transport Agreement which will provide for market access for UK and EU airlines.</p> more like this

answer text <p>The latest proposals in the EU Mobility Package establish a road transport sector-specific regime for the posting of workers. This is intended to provide an enforceable and proportionate set of rules, based on harmonised administrative requirements for drivers and operators and on information exchange between Member State authorities. The Government’s assessment is that this will reduce administrative burdens that can be placed on UK-based drivers operating abroad. It is also proposed to introduce a limited exemption from posting rules for bilateral international operations. UK-based drivers may therefore in some circumstances be exempt from the prevailing local minimum wage rate while working in other Member States, although this would not be expected to entail a change to their contractual entitlement.</p><p> </p><p>The latest proposals in the EU Mobility Package are that the driving and rest time rules would be modified to enable a driver to return to their base at least once every four weeks. In this context, to enable more of a driver’s rest time to be taken at home, it is proposed to enable drivers to take two consecutive reduced weekly rests, provided the reduction is compensated for. The Government considers that these rules would have a very limited effect on UK-based drivers, whose working patterns do not normally entail multiple weeks away from home.</p><p> </p><p> </p>

answer text <p>28 NDAs relating to Brexit Preparations have been signed between DfT and its stakeholders since July 2016.</p><p> </p><p>Government Departments continue to engage with a wide range of businesses to understand their priorities and issues as we leave the European Union, both to inform our negotiating position, and our preparations in the unlikely event of there being no deal.</p><p> </p><p>Departments can make use of non-disclosure agreements (NDAs) when structuring their engagements on preparations for leaving the EU, which is a crucial component of planning. It is for departments to determine the manner in which engagement with stakeholders takes place. Given the sensitive nature of some discussions, there may be limited circumstances in which departments have used NDAs to enable those conversations, thereby reaching more stakeholders than would otherwise be the case.</p><p> </p><p>NDAs are also a common component of contractual arrangements that are used to protect commercial considerations of the parties involved or to protect sensitives around the development of Government policy.</p><p> </p><p>It is entirely normal practice to use such agreements and they are therefore sometimes necessary for Government departments that are responsible for managing their preparations for leaving the EU.</p>
