answer text <p>The Department will not be publishing anything in regards to the condition at Baverstock Academy. The Ofsted reports, the Financial Notice to Improve issued on 13 November 2015, and the Trust’s annual reports / financial statements are publicly available documents that provide an overall picture of the issues facing the academy trust. Potential sponsors would also have considered these documents and the following criteria in their due diligence and assessment of risks; current and projected pupil numbers; the quality of teaching and learning; overall financial position, condition of the buildings, and staffing numbers.</p><p>The primary objective of the department in making any decision about the future of Baverstock Academy is to secure value for money for the taxpayer whilst ensuring the best possible educational outcomes for the pupils and parents.</p><p> </p><p> </p><p> </p> more like this

answer text <p>Although the Department holds detailed information on individual cases we do not record it in a way that allows us to quantify in how many instances a proposal for a sponsor to take on a failing school has not been approved because of the potential risk to the sponsor’s performance and financial health.</p><p>Regional Schools Commissioners are responsible for taking decisions on the creation and growth of Multi Academy Trusts. As such, they will take into account a number of factors about the capacity of the sponsor before reaching a decision to allow them to take on a failing school.</p><p>More information on this is detailed in the <em>Regional schools commissioners decision-making framework</em> (published April 2016) and in <em>Multi-academy trusts: good practice guidance and expectations of growth</em> (published December 2016), both are on gov.uk.</p><p> </p><p> </p> more like this

answer text <p>When considering solutions for underperforming schools which require sponsors, my department assesses conditions at the school including the state of leadership and governance; the school’s financial health; building conditions and pupil numbers, alongside any other issue that the school may be dealing with. We also consider the current and prospective performance and financial health of any sponsor and the relative benefits of the various options available to enable children to get a good education. All these factors can be relevant to whether the performance of the underperforming school can be substantially improved.</p><p> </p><p>Officials approached five sponsors to negotiate the rebrokerage of the Baverstock Academy. All but one felt that the academy posed too great a risk to the performance and financial health of the schools within their trust. This sponsor submitted a proposal to sponsor the Baverstock Academy. After completing a review of the conditions at Baverstock, and the various options available, the department judged that the academy could pose too great a risk to the overall performance and financial health of the potential sponsor, and the chances of them improving the performance of Baverstock Academy substantially were very uncertain. Given the circumstances, closure and locating to another school was a better option for the pupils at Baverstock Academy. This judgement led to the announcement of the in-principle agreement to terminate the funding agreement.</p>

answer text <p>A final decision has not yet been made on the future of the Baverstock Academy. The ‘listening period’, which commenced on 10 January and ended on 7 February, was to invite the community and stakeholders of Baverstock Academy to make representations to the Secretary of State. The Department does not provide information, financial or otherwise, to the public as part of this process.</p><p>As part of the transparency of academy trusts, they are required to publish their financial accounts annually on their website. This information was therefore readily available to the community and stakeholders to inform their representations to the Secretary of State.</p><p>The Secretary of State will review the submissions from the community before reaching a final decision. Consideration will be given to all representations to ensure that whatever decision is reached will be in the best interests of the students and local community of Baverstock Academy.</p> more like this

answer text <p>School closure is managed on a case by case basis so the department does not publish formal criteria. When assessing the cost implications of a case we consider a range of factors. These factors could include: actual and projected pupil numbers for the school; the local demand for places and the capacity of provision in the local area to meet this; the quality of education provided by the school and any existing or projected deficit position.</p><p>The department’s priority in making decisions about the future of any school is to assess which option will deliver the best educational outcomes for local children so that all children should have access to good or outstanding schools whilst maintaining efficient and effective use of resources.</p><p> </p> more like this

answer text <p>I refer the honourable member to my response to question 58097, which I have restated below.</p><p>The Department’s guidance on consultation sets out the minimum periods for which local authorities and academy trusts must consult, where school closure is proposed, but it does not mention pausing a consultation.</p><p>Consultation on a proposal to close a school is undertaken locally either by the local authority or the academy trust to allow those directly affected by the proposals to provide their comments.</p><p>It is up to the local authority or academy trust to decide whether a consultation needs to be paused. The Department does not record or hold this information centrally.</p> more like this

answer text <p>As civil servants, Regional Schools Commissioners (RSCs) are subject to the civil service performance management framework. Their performance is also monitored against a number of Key Performance Indicators, which cover their four core remits:</p><p> </p><p>1. Taking decisions on the creation of new academies</p><p>2. Ensuring there are enough high-quality sponsors to meet local need</p><p>3. Monitoring academy performance and tackling underperforming academies and free schools</p><p>4. Providing advice and making recommendations in relation to free schools, university technical schools and studio schools.</p><p>The RSCs are accountable to the National Schools Commissioner, Sir David Carter.
